Non-tenured jurist nabs Bergen County Assignment Judge post

Carol Novey Catuogno will succeed Bonnie Mizdol in May

Carol Novey Catuogno will be the new assignment judge in Bergen County, the state’s largest vicinage, Chief Justice Stuart Rabner announced today.

She will replace Judge Bonnie Mizdol, who is retiring after more than 17 years as a Superior Court Judge.

A 56-year-old Republican named to the bench by Gov. Chris Christie in 2018, Novey Catuogno’s has enjoyed a rapid rise through the judicial ranks to get the top post after just five years on the bench.  She is up for tenure in February 2025.

Novey Catuogno is a career prosecutor who spent seven years with the Staten Island District Attorney’s office and then over 20 years as an assistant Bergen County Prosecutor.    She led the domestic violence division and served as Executive Assistant Prosecutor under Gurbir Grewal, who later became state attorney general.

“Judge Novey Catuogno brings vast experience to her new role from an extensive career in public service,” said Rabner, who made the appointment.  “I have every confidence in her ability to lead the Bergen Vicinage.”

Novey Catuogno spent ten months as a family court judge before being elevated to the criminal section in 2019.  She has never served as a presiding judge.

She will assume her new post on May 1.

The civil division presiding judge, John O’Dwyer, and Peter Melchionne, the family court presiding judge,  both reach the mandatory retirement age of 70 in 2027; it’s not clear if either applied for the post. Judge Margaret Foti, the criminal court presiding judge, will retire in August when she turns 70.

It’s also not clear if Essex County Family Court Presiding Judge David Katz, a perennial candidate for an assignment judge post in several other counties, applied to succeed Mizdol.

Bergen County Courthouse Update: Nine New Judges Nominated to Superior Court

An often heard complaint of people who are in need of access to the courts, whether they are sued or wish to sue, is that the wheels of justice spin slowly, if at all.  The school of thought has, for a long time, been that a law suit filed today will not be heard by a judge for years.  In the interim, the expense, inefficiency and bureaucracy often make the system frustrating and intimidating.

Well, hopefully, times are changing in Bergen County.  Just last week, the New Jersey Senate confirmed Governor Christie’s nomination of nine new judges to the Superior Court.  While the division assignments for the new judges have not yet been officially announced, the addition of so many new judges will go a long way towards lessening the frustration of the system.

Recently, Bergen County’s Assignment Judge, the Honorable Peter E. Doyne, A.J.S.C., placed a moratorium on any civil trial that would potentially last more than two weeks.  With the new judges soon on the bench, we can now hope that the wheels of justice will spin at a more consistent and steady pace.

Hon. Bonnie J. Mizdol

Areas of practice.

Hon. Bonnie J. Mizdol, formerly the Assignment Judge of Bergen County for eight years, joins the firm’s alternative dispute resolution and corporate investigations practices. Appointed to the Superior Court in February 2006, Judge Mizdol served as Presiding Judge of the Family Part of Bergen from 2008 through April 2015.  In both capacities, Judge Mizdol accumulated vast experience in a wide spectrum of matters, ranging from matrimonial to probate, condemnation, and OPRA cases.  Judge Mizdol presided over scores of proceedings, including bench trials and emergent actions in all phases.

Judge Mizdol actively participated in judiciary committees, councils, and the like. She chaired numerous Supreme Court Committees, including the Judiciary-Surrogates Liaison Committee; the Working Group on Elder Justice; the Working Group on Pro Bono Assignments; and the Special Committee on the Non-Dissolution Docket. She also served on the Judicial Council. She served as a member of the Judicial Council Labor Relations and Personnel Committee, the Judiciary Budget and Planning Committee, and the Management and Operations Committee.

During her tenure as Bergen’s Family Part Presiding Judge, she chaired the Conference of New Jersey Family Part Judges, the Supreme Court Family Practice Committee, and the Ad Hoc Committee on Arbitration of Family Matters. Judge Mizdol also served as the New Jersey Designated Representative for the International Hague Network of Judges from 2017 through her retirement.

Judge Mizdol was in private practice for 24 years before her appointment to the Superior Court. While in private practice, she also served as a Municipal Court Judge for 15 years before her appointment, and as President of the Bergen County Municipal Judges’ Association. Before joining the Superior Court, Judge Mizdol focused on matters in the family, estate, and probate dockets. In addition, she handled personal injury matters, commercial and residential real estate sales, purchases, leases, and land use and development.

Before her service in the judiciary, Judge Mizdol actively participated in the New Jersey and Bergen County Bar Associations, where she served as President of the Bergen County Bar Foundation, Chair of the District IIA Ethics Committee, Co-Chair of the Bergen County Family Law Committee, and member of the New Jersey Family Law Executive Committee.

Judge Mizdol was graduated from Seton Hall Law School and Montclair University.

October Challenge to Judge Was Timely Though Parties Knew of Assignment to Her in June

Raphael Says Advisement by Commissioner That Judge Would Handle Trial Had Potential of Constituting All-Purpose Assignment

Div. Two of the Fourth District Court of Appeal has held that an “all-purpose” reassignment of a case to a judge, triggering a 15-day period within which a peremptory challenge to that judge may be filed, can be effected by an oral announcement at a court hearing by the bench officer who is presiding—but only if that bench officer ceases handling any substantial matters in the case.

Otherwise, the reassignment is not an “all purpose” one, Justice Michael J. Raphael said in an unpublished opinion issued on Thursday.

Raphael declared that a challenge to Riverside Superior Court Judge Susanne S. Cho, filed on Oct. 5, 2023 by the petitioner in a divorce case, Robert Taylor, was timely although Commissioner Mickie Reed advised counsel at a June 2023 hearing that Cho would preside over the trial in November. That advisement did not constitute an all-purpose assignment, he declared, because Reed held onto a “substantial” matter, conducting a hearing on it in August.

 “Judge Cho would have been assigned to the case for all purposes in June so long as she processed all substantial matters from that moment on,” Raphael wrote.

Trial Assignment

He said that in June, there was merely an assignment for trial purposes, so that the clock did not start running on a 15-day period for filing a challenge after an all-purposes assignment is made. That time limit is set forth in Code of Civil Procedure §170.6.

On Oct. 4, 2023, Taylor, apparently not taking heed of Reed’s notification in June that Cho would preside over the trial, filed a paper indicating a lack of assent to a trial before a commissioner, and on the same day, the court issued a “Notice of Case Reassignment For All Purposes,” shifting the case to Cho. The following day, Taylor filed a challenge to Cho which the judge proceeded to spurn, proclaiming that the parties had known since June of the entrusting of the case to her. The appeals court directed the issuance of a writ of mandate requiring Cho to step aside. Raphael wrote:

“Applying the all purpose assignment rule here, Taylor’s motion was timely. He moved to disqualify Judge Cho one day after notice that the case had been reassigned to Judge Cho for all purposes. It was therefore “made to the assigned judge...within 15 days after notice of the all purpose assignment.”

Two Reasons

Explaining why an all-purpose assignment had not been made in June, he said there are “two reasons, one formal and one functional,” elaborating:

“The formal reason is the timing of the case reassignment notice. If the case had been reassigned to Judge Cho for all purposes in June, then the notice of reassignment would have been issued then, rather than the day Taylor sought ‘reassignment of the case to a Superior Court Judge for all matters.’ ”

Raphael continued:

“The functional reason is that a substantial matter remained before Commissioner Reed even after she set trial dates in Judge Cho’s department.”

He quoted the California Supreme Court as saying in a footnote in its 1993 decision in People v. Superior Court (Lavi) that the all-purpose assignment rule applies only where “a single judge must handle every matter in a given case.”

Question Left Open

The justice left open the question of whether there would have been an all-purpose assignment in June if a notice of assignment had been issued then even though Reed retained a matter, saying:

“The combination of the formal and functional reasons here means we need not decide whether one would be sufficient here without the other.”

The case is Taylor v. Superior Court , E082661.

Pittsburgh Pirates Trade Intriguing Righty to Los Angeles Angels

After being designated for assignment recently, pitcher Roansy Conteras has been traded to the Los Angeles Angels by the Pittsburgh Pirates.

A later report indicated that the Pirates received cash in the deal. This is the second pitcher the Pirates have lost in as many days as veteran lefty Eric Lauer opted out of his deal and became a free agent.

The 24-year-old Contreras is a worthwhile gamble for the Halos. He's under control through the 2028 season, is just 24, and already has major league experience. He made his debut in 2021 and is 9-12 lifetime with a 4.83 ERA. He won five games back in the 2022 season and has made 30 starts throughout his career.

This year, he served exclusively as a reliever with the Pirates, so it's not known yet where the Angels will deploy him. Conteras pitched in 12 games this season with a 4.41 ERA, striking out 16 batters in 16.1 innings. The Pirates now have Jared Jones and Paul Skenes up at the big league level, so there's been less room for Contreras in the rotation, and now even on the 40-man roster.

The Pirates are 19-25 on the season entering play on Thursday. They'll take on the Chicago Cubs as part of a limited slate of Thursday games. First pitch is set for 7:40 p.m. ET as Jones pitches against Cubs' lefty Justin Steele.

Video Shows Serial Groper Trying To Drag Woman Behind Garfield Church: Investigators

G arfield police have surveillance video of a man with a history of groping women who they said rushed up and grabbed one from behind, then tried to drag her behind a church.

Michael Hernandez, 25, of Ridgefield Park is seen following and then running up to the victim outside Praise Assembly church at the corner of Main Street and Banta Avenue shortly after 12 noon May 8, investigators said.

He then grabbed her by her neck and backpack and unsuccessfully tried to drag her behind the church, they said.

The woman, who wasn't injured, went to police headquarters and identified Hernandez from a photo lineup, according to a complaint filed in Superior Court in Hackensack.

Hernandez was seized on Thursday, May 16, and remains held in the Bergen County Jail, charged with kidnapping and stalking.

Calling Hernandez "known to police" would be an understatement.

During one stretch in 2022, he was arrested three times in a little over a month.

In one, Hernandez and two other men stole a cab in Union City that crashed a short time later during a police pursuit in Fairview, injuring two women in another vehicle.

The driver face-planted trying to flee on foot and was captured, as was a passenger who had to be yanked from the vehicle by officers.

Hernandez got away during the commotion but was arrested at his home the following day and sent to the county jail.

A judge released Hernandez, who groped a 40-year-old Ridgefield Park woman a short time later.

Freed again, Hernandez attacked an elderly village woman in late 2022, rushing up and grabbing her from behind in broad daylight, police said at the time.

Hernandez served more than 10 months in the Bergen County Jail before being released in late November 2023.

The Yankees infielder began another rehab assignment with Double-A Somerset on Friday, nearly a month after his initial rehab stint ended with a setback with his injured right foot.

LeMahieu, who suffered a non-displaced fracture in the foot during spring training, started at third base and batted second Friday for the Patriots.

He went 1-for-2 with an RBI infield single before being replaced after three innings. Yankees manager Aaron Boone had said LeMahieu was expected to play between three and five innings.

The 35-year-old is likely more than a week away from joining the big-league club, Boone said Friday, but he could be back at some point during the team’s upcoming nine-game West Coast swing.

“I think a week is probably not realistic, just because he’ll need a little bit of a buildup, and with off days in there, so I think it’s possible at some point on the trip,” Boone said. “But I don’t expect the start of it, certainly.”

The Yankees began a seven-game homestand Friday with the first of three against the Chicago White Sox. They’ll host the Seattle Mariners for a four-game series in the Bronx next week before embarking on their trips to San Diego, Anaheim and San Francisco between May 24 and June 2.

LeMahieu suffered the fracture on March 16 when he fouled a ball off of the foot . He played in his first rehab game on April 23 with Double-A Somerset but lasted only one inning before leaving the game with soreness.

He was then shut down for a week after being diagnosed with swelling in the foot and has ramped up his baseball activities over the weeks since.

A two-time batting champion, LeMahieu posted a career-low .243 average in 2023 but hit .273 in the second half.

Boone spoke in the spring about his desire for LeMahieu to be the Yankees’ leadoff hitter ahead of superstar sluggers Juan Soto and Aaron Judge. Known for his positional versatility, LeMahieu was supposed to begin the year as the primary third baseman.

Second-year shortstop Anthony Volpe has largely operated as the Yankees’ leadoff hitter in LeMahieu’s absence.

Volpe entered Friday with a .273 average and a .348 on-base percentage, and while those numbers dipped to .243 and .320 when he hit out of the leadoff spot, the 23-year-old has been on a tear of late. He took a nine-game hitting streak into Friday’s series opener and boasted four multi-hit outings over that stretch.

“Even when he went through a little bit of a downturn, I’m seeing just a consistent approach,” Boone said of Volpe. “As I’ve said a lot with him, I think he’s a way better hitter than he was even at the end of last year. He’s made noticeable adjustments that are still accentuating the things that he does really well but also are making him consistently a much tougher out.”

Last year, Volpe hit 21 home runs and stole 24 bases, making him the first Yankees rookie to record a 20-20 season. He also won a Gold Glove at shortstop but hit .209 and said after the season that he “didn’t even come close to cutting it.”

“I think his swing is better, so there’s more margin for error within his swing,” Boone said Friday. “He’s using the entire field better, so I think that’s allowing him to see the ball longer and ultimately make better swinging decisions.”

KAHNLE’S CLOSE

The Yankees bullpen could soon receive a big boost, as Boone acknowledged it is “possible” Tommy Kahnle could join the team as soon as Tuesday.

The right-hander hasn’t pitched this season after experiencing shoulder inflammation in spring training.

“He’ll go again Sunday, is the plan, and then we’ll kind of evaluate where we’re at from there,” Boone said Friday.

Kahnle has thrown four scoreless, hitless innings over four rehab appearances with Single-A Tampa and Double-A Somerset since May 8. That includes a dominant 1-2-3 inning with Somerset on Thursday in which he struck out the side.

Kahnle pitched to a 2.66 ERA and 48 strikeouts over 40.2 innings for the Yankees last season.
