An RTI Application Form is a letter through which an Indian citizen can request information from the offices and departments of the state and central governments , also known as " Public Authority" . This can be used for any kind of information which is supposed to be in public knowledge.

An RTI Application specifies the information sought from the department and the period for which the information is required . This letter can be used to seek information from the Central Government to Local Governments and any such public offices. This includes:

1. Disclosure on their organization, functions and structures;

2. Powers and duties of its officers and employees;

3. Financial information.

The right to information is regulated under the Right to Information Act, 2005 (RTI Act) .

The Public Authority includes bodies of self-government established under the constitution or under any law or government notification. It also includes any entities (for instance Non-Government Organization) owned, controlled or substantially financed by the government .

Under the RTI Act, Public Authorities (government officials) are required to disclose various aspects of their structure and functions . The Right to Information under the RTI Act includes the right to:

  • Inspect works, documents, records;
  • Take notes, extracts or certified copies of documents or records;
  • Take certified samples of material;
  • Obtain information in the form of printouts, tapes, video, or any other electronic mode.

Some information, however, is restricted information and cannot be disclosed under the RTI Act . Restricted Information includes:

  • The information, disclosure of which would adversely affect the sovereignty and integrity of India , the security, strategic, scientific or economic interests of the state, relation with foreign State or lead to incitement of an offence.
  • The information which has been expressly forbidden to be published by any court of law or tribunal or the disclosure of which may constitute contempt of court (disobedient to the court).
  • The information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of the third party , unless the competent authority satisfied that larger public interest warrants the disclosure of such information.
  • The information which would impede or affect the process of investigation, apprehension or prosecution of offenders .
  • The personal information , which has no relationship to any public activity or interest or which would cause unwarranted invasion of the privacy of the individual.

An Indian citizen can only use this Application Letter to request any information from the public offices and departments in India. Any citizen of India has the right to get the Information sought within 30 days from the date of application, but the period can be extended in exceptional situations. If the information sought is voluminous or the inspection is required, then the Applicant through this letter can apply for allowing a time slot for inspection of the public documents.

How to use this document?

This document includes the mandatory information such as details of the department, the information sought, supporting documents, details of the Applicant and so on. The information/documents sought must be clear and specific to avoid any delay or confusion.

After filling this letter, the Applicant shall sign the document. The Application can be submitted to the concerned department either through an online or an offline method. The name and address of the concerned Authority can be found at their respective websites.

RTI Application fee may be in the range of Rs 10/- to Rs 100/- (subject to states and UT's).

A copy of the Application can be kept by the Applicant for any future reference . If the RTI Application is submitted directly at the office, it is better to take acknowledgement from the concerned officer.

After gathering the above information, you may visit Tahsildar office ( or Taluka Inspector of Land Records - TILR) and inspect the entire land records of that village. If the land records of your village are available from any oldest date, you have to search land record from that date. You can identify the land details from names of ancestors from the Record of Rights. You can cross verify these details from Tax Register, Heirship Cases Register which indicate the name(s) of deceased landholder and his heirs, who are your ancestors in lien. Cross verification is required since a village must have many persons with same name & surname. OBTAIN CERTIFIED COPY IN NORMAL PROCESS On locating and pinpointing details of the land such as survey number, sheet number, Khasra number etc, from above-mentioned records, you may inspect the history of this land from the Register of Mutation with respect to the survey numbers identified by you. Register of Mutation shall indicate all the orders passed by Revenue Officers over a long period of many decades and the position of the present title holder. You can demand certified copy of the concerned pages or records from the Revenue-officer concerned or TILR. OBTAIN CERTIFIED COPY BY RTI PROCESS On the other hand, if you know the land details such as survey number, sheet number, Khasra number, village etc., you can search such records from the Online Land Rerecord of the state concerned.   • Names of all persons who have acquired some rights in the land, nature and limits of their rights and conditions under which the rights are acquired by them. Rent or revenue required to pay for them.
  • Details of charges of attachment and decrees under the order of a civil court or revenue authorities.
  • Details of loan taken by the occupant.
  • If the land is classified as a fragment , the same is noted in this record.
  • Easement, such as right of way is entered in this record.

[5] Record of Crops / Crop Statement / Registrar of Crops ( Form-XII) (It is also known as Field Book in some states) This Register contains the details of crops, trees, uncultivated area during current season, area of buildings, roads, river-nallas, grass area etc. [6] Record of Land Revenue – Form-VIII-A: This is the Record of Land Holders’ Tax Account. This shall indicate the area of the parcel of land and land revenue payable etc. [7] Record of Land Possession – Form VII-B: This is registered of persons whose names are not entered in Record of Rights as an occupant, but are in actual possession of the land. Adverse possession over a long period shall confer ownership to such possessor. The entries in above records are evidence of the facts recorded therein under section 35 of the Indian Evidence Act. These land records are open for inspection under the land revenue codes.

Certified copies through RTI process as below

  • 1. Login to your RTI portal by entering Username and Password at below link

https://rtionline.gov.in/

  • 2. Now, click on submit request option, scroll down and click on the checkbox “I have read and understood the above guidelines.” and then click on submit button.
  • Then Online RTI Request Form screen will be displayed. This form can be used to file an online RTI application.
  • 3. In search Public Authority filed enter key word as  Chartered  and select Institute of Chartered Accountant of India from the drop-down list and click on Ok.
  • 4. Name, address, educational qualifications, communication details will be auto filled and you can change the same, if required.
  • 5. In the field “Is the Applicant Below Poverty Line?”
  • –  Select the option  Yes , if you belong to Below Poverty Line BPL category and holds valid proof for the same as Food security Card, ration card etc., 
  • No application fee is required to be paid by such citizens as per RTI Rules,2012
  • –  Enter BPL card number, year of issue, issuing authority in the next field.
  • –  Select the option  No , if you are not fall under the BPL category or does not hold valid proof for the same. Such candidates are required to be paid application fee of Rs.10/- online.
  • 6. Now in the filed “Text for RTI Request application”, provide details and request for certified copies
  • –  You can download the draft application format from click here .
  • 7. Now, upload your merged pdf copy of  BPL Card  (if applicable) and  Hall Ticket  by clicking supporting document and
  • –  click on submit button (if BPL category)
  • –  Make payment button (Others) to make the payment of Rs. 10/- towards application fee by using Internet banking, credit or debit card and click on submit button, after making the payment.
  • 8. On submission of the application, a unique registration number would be issued, which may be referred by the applicant for any references in future. The applicant will get an email and SMS alert on submission of the application.

Reply from ICAI and additional fee payment:

You can check the status of your application  after 30 days  from the date of online application by clicking  Disposed of link  from the homepage. You can click on view status and enter Registration Number, E-mail id, Security code and click on submit, you will be intimated about the amount of fees to be paid by the way of Demand Draft or Indian Postal Order.

Take a Demand draft or Indian Postal Order for the prescribed amount drawn in favour of The Secretary, The Institute of Chartered Accountants of India, payable at New Delhi and the same has to be sent to the CPIO by the speed post to below address by mentioning your name and RTI application number on the back side of the Demand Draft or Postal order.

Within one week from the date of receipt of your Demand Draft or Postal order at the aforesaid address your certified copies will be sent to the address mentioned in the RTI application through India Post.

Electronic Demand draft – Convenient and easiest way:

While applying for DD mention your RTI application number and mention DD delivery address as follows:

Bank will courier DDs to the mailing address and deliver within 3 days because ICAI Head office is in Delhi. You will be updated with the courier carrier details and delivery details on time to time.

On receipt of DD, CPIO will provide the information/ certified copies in 3-6 working days through speed post to the address mentioned in the RTI application.

Frequently Asked Questions with respect to certified copies under RTI. 

1. whether icai will provide certified copies under rti .

To establish and follow the law laid down by Supreme Court in the judgement ICSI Vs. Paras Jain, ICAI appointed CPIOs exclusively for providing certified copies under RTI dated 29th Aug 2019.

2. How many days it will take to get certified copies under RTI? 

As per RTI act, information to an applicant shall be supplied within 30 days from the receipt of application by the public authority. 

3. Can we seek certified copies of another student under RTI? 

No, we cannot make an application for answer sheets of other student, as Sec 8(1)(j) of RTI Act exempts the disclosure of personal information of an individual which has no relationship to any public interest or activity. 

4. Whether we are required to upload handwritten application like in case of ICAI process? 

Application need not be in handwritten. ICAI process and RTI process both are different platforms. 

5. What documents are to be uploaded under supporting document? 

To prove the identity, I suggest you upload Admit card/ hall ticket/ any other supporting document like student card, exam form etc., 

And upload your Food security card or Ration card, if you are falling under Below Poverty Line Category, to claim exemption from application fee of Rs. 10. 

6. Whether we should send print-out of the RTI application physically to the institute? 

No, there is no such requirement to send the application form physically. Once you have filed application at RTI portal, the same will reflect under CPIO’s dashboard and he will take further action to provide certified copies. 

7. Can we get certified copies of previous attempt? 

As per the RTI act, 2005 information can be sought as far as it is available with the public authority. As per ICAI regulations 39(4) answer books are retained for a period of four months (120) days from the date of declaration of result. 

8. Whether Institute will do suo-moto verification of marks for certified copies sought under RTI and student can report discrepancies, if any? 

As per RTI Act, there’s no such provision which mandates suo-moto verification. But, as per the sources it was informed that Institute is carrying out suo-moto verification of marks like retotaling errors for applications under RTI Act and if there are any discrepancies, student can bring it to the notice of the Institute. 

9. Whether we can choose any option like softcopy/hardcopy format of certified copy? 

No, we don’t have any such option. It solely depends upon the institute in which format they want to provide. ICMAI and ICSI- Decided to provide in Hard copy format by charging Rs. 2 per page and ICAI – Decided to provide in soft copy format at free of cost. 

10. Whether we can seek MCQ paper and answers under RTI? 

ICAI mentioned that “only copies of OMR answer sheet will be provided upon receipt of an application in this regard, under this scheme. Neither MCQ paper booklet nor the answer keys thereon will be provided, and the certified copy of OMR answer sheets will not bear the Mark’s awarded since the same are awarded in the System.” But, the RTI Act has over-riding effect vis-à-vis other laws and ICAI must disclose the same under RTI Act, 2005. 

11. Where we can check the status of our application? 

Whether we will receive certified copies on mail or post? 

You can check the status of your application on RTI portal through below link:  https://rtionline.gov.in/request/status.php  

12. On ICAI portal it is showing still Rs. 500 per paper and you are saying free of cost? 

ICAI procedure and RTI process both are different platforms. The existence of these two avenues is not mutually exclusive and it is up to the candidate to choose either of the routes. ICAI can still charge Rs.500 as per ICAI guidelines for the application made at ICAI portal and Institute will provide certified copies at free of cost (ICAI) or at nominal cost of Rs. 2 per page (ICMAI) for an application under RTI Act, 2005. 

13. Refund of fee paid through ICAI portal? And whether ICAI will take any action if we apply under RTI? 

As earlier said, ICAI procedure and RTI process both are different platforms. The existence of these two avenues is not mutually exclusive. You won’t get any refund of the application made for certified copies at ICAI portal. ICAI can still charge Rs. 500 per subject for application for certified copies received through https://icaiexam.icai.org portal. Providing certified copies under RTI act, 2005 is as per law laid down by the supreme court, ICAI wont take any action. 

14. What is the exact process to get certified copies under RTI? Whether we have to make any payment through DD? Rs. 2/- page or free of cost? 

Please, refer to our article for complete information. I will summarize the entire process quickly for your reference. 

Firstly, file an application seeking certified copies at RTI portal. At the time of filing application, you are required to make payment of Rs. 10 towards application fee and if you fall below poverty line category the same is not required. Just relax and wait for 30days. You are not required to contact CPIO/ Send mail/ Physical copy of your application Within 30 days Institute will reply on RTI portal itself. In the case of ICAI, you will receive a link to download the PDF copy of your answer sheet and no fee is required to be paid. Whereas, in the case of ICSI and ICMAI, you will receive a notification by SMS and Email that institute has responded to your application. Login to RTI portal, make the payment and you will receive hardcopy of the answer sheet within 7-15 days by speed post. 

15. To whom we should contact if we haven’t received certified copies within 30days? 

You can contact CPIO of the respective institute. There may be no timely response on e-mail, try to reach the CPIO over Telephone during the office hours.
