On this page, you may not be able to use some characters or accent marks, changing the name on your adult passport, changing the name on a child passport, dropping or inverting given names.

Reclaiming your indigenous name, changing the name on your passport can cause problems.

Be sure to make all of your travel bookings, such as tickets and hotels, in the name you have on your passport. Your ID should also ideally match the name you have on your passport.

If the name on your passport doesn’t match your bookings or other ID, you might have problems such as

  • delays at border crossings
  • not being allowed on your plane, boat, train or bus
  • countries not allowing you to enter

This could happen even if you carry your marriage or civil partnership certificate, legal change of name documents or proof of citizenship with you.

You can ask the consulate of the country you plan to visit about your name change. If you have a travel agent, you can also ask them.

All systems that handle passenger data, including personal identity information, follow the ICAO guidelines. This makes sure no matter where you travel, your passport or travel document works across computer systems.

The process is the same as applying for a new adult passport. However, because we’re changing the name on your passport, you need to give us some extra documents.

The application form and the steps to submit your application depend on where you’re applying from.

Because we’re changing the name on your passport, you also need to include

  • a relationship change

You no longer need an updated proof of citizenship

You don’t need a new proof of citizenship if your name has changed because of

  • an adoption
  • a court decision
  • a legal name change

Your proof can have your old name or your new name on it.

Ignore the proof of citizenship instructions in section I on the form

Under the instructions for section I, it says you need an updated proof of citizenship. Ignore this and follow the instructions on the website instead.

If you have multiple given names on your proof of Canadian citizenship, you may ask for your given name(s) to be slightly different on your passport. You must be applying for a new adult passport to do so .

  • drop given names
  • invert given names

If you’re dropping or inverting your given name(s), the name you want on your passport must be the same as the name that’s on your supporting ID.

Changing your last name due to a change in relationship status

You need to apply for a new passport if you’re changing your last name due to a change in your relationship status. This could be a marriage, civil partnership or divorce. You’ll need to include all the required documents for a new application and pay the fees. The ID you provide with your application needs to show your new last name.

You also need to include 1 or more of the following documents. They can be originals or copies:

  • marriage certificate
  • common-law relationship certificate
  • separation agreement
  • divorce order or judgment
  • certificate to dissolve a registered common-law relationship
  • resumption of surname certificate

These documents

  • must show the last name you’re asking for on your new passport

Changing your name after a legal name change, court order or an adoption order

You need to apply for a new passport if your or your child’s name has changed after a legal name change, court order or an adoption order.

The supporting ID you include with your application needs to show your new given name(s) and last name.

If your or your child’s proof of citizenship does not have the new legal name, you need to submit the proof of citizenship in your or your child’s previous name and provide one of the following documents:

  • a legal name change certificate
  • an adoption order
  • a court order

Whichever of these documents you give us, it must have both of the following:

  • your new name and
  • your old name

They can be the original or a photocopy. If you’re applying by mail we suggest sending photocopies so you can hold on to your originals.

We may need further documents or information if you got these documents outside of Canada. If they’re not in English or French, they need to be translated by a certified translator. Learn more about translations .

You need to submit a new application to change the name on your passport back to the  previous one.  You must also submit documents supporting the name change:

  • changing your last name due to a change in relationship status
  • legal name changes, court orders or adoption orders

You can change the name on your or your child’s passport or travel document to reclaim your Indigenous name. To ensure your passport or travel document is machine-readable, names can only be written in letters from the Roman alphabet and some accented letters .

There is no cost for this until May 30, 2026. Your updated passport or travel document will have the same expiry date as the current, valid one.

Passport gender change

In June 2021, the State Department announced that it would no longer require passport applicants to submit medical certification to change the gender marker on their passports. Under this policy, a transgender person can obtain a passport reflecting their gender by submitting an application with the chosen gender marker selected. This policy replaced the Department’s old policy requiring certification by a physican of appropriate clinical treatment for gender transition, which had been in place since 2010.

As of 2022, applicants may self-select an M, F, or X gender marker for their passport. 

Can I Get a Passport With My Current Gender?

Under the current policy, you can obtain a full ten-year passport with an updated gender marker upon request by filling out an application form and indicating whether you would like your gender marker to read "M," "F," or "X."

Do I Need a Physician’s Certification?

No. As of June 2021, State Department policy is that changing the gender marker on a U.S. passport does not require a physician's certification. You may select the gender marker you wish to appear on your passport by choosing one of the available options on an application form. No additional documentation is necessary.

Does the State Department Need Other Medical Information?

You do not need to submit any details or documentation regarding your medical history or treatment in order to update your gender marker. Your doctor does not need to certify that you have undergone any specific treatment or procedure and we recommend, for the sake of your privacy and in order to not confuse the process, that you do not include any additional medical information with your passport application.

Can Transgender Children Get Updated Passports?

The current gender change policy applies to both adults and minors. All passport applications for minors are subject to special parental consent requirements. (These requirements apply to all minors, not just transgender minors.) See the State Department instructions on applying for a passport for children under 16 or for applicants age 16 and 17 .

How Do I Apply for a Passport?

Updating your gender marker on an existing passport or getting a passport for the first time.

If you are applying to change your gender marker, submitting a passport application for the first time, or applying for a passport when your old passport has expired, you must apply in person .

You will need to complete and submit: 

  • Application for U.S. Passport ( Form DS-11 );
  • Proof of U.S. Citizenship (such as a previous U.S. Passport, certified Birth Certificate, Certificate of Naturalization, or Report of Birth Abroad);
  • Proof of Identity that contains your signature and photograph that is “a good likeness to you” (such as a previous U.S. Passport, a Driver’s License, a Certificate of Naturalization, Military Identification, or a Government Employee Identification Card). You must present the original AND provide a photocopy of the front and back side with your application;
  • A recent color photograph 2x2 inches in size;
  • If you are changing your name on your passport, an Order for Name Change (certified copy showing a seal and officiate/judge signature);
  • Fee ( See Department of State Passport Fees for cost). 

Take these documents and fees in person to any Passport Acceptance Facility. To find the acceptance facility closest to you, visit the State Department’s website, Passport Acceptance Facility Search Page, at  http://iafdb.travel.state.gov  or call the National Passport Information Center at  1-877-487-2778.

Updating your legal name only (no gender marker update) on an existing valid passport.

When you already have a valid Passport, you may submit a  Passport Renewal Application  to change your legal name on the passport by mail. You will need to complete and submit: 

  • A Passport Renewal Application ( Form DS-82 );
  • Your most recent Passport (book or card);
  • Order for Name Change (certified copy showing a seal and officiate/judge signature);

What is a Passport Card and How Do I Apply For One?

A U.S. passport card is a wallet-sized card that looks like a driver’s license. A passport card is significantly less expensive than a traditional passport book but cannot be used for international travel by air. A passport card may be used as everyday identification within the United States and may be used to enter the United States from Canada, Mexico, the Caribbean and Bermuda at land border crossings or sea ports-of-entry. Application forms and documentation requirements for a passport card are the same as for a passport book; simply check “passport card” instead of or in addition to "passport book" on the application form.

How Do I Change a Limited Validity to a Full Validity Passport?

As of October 2021, it seems that the State Department no longer distinguishes between a transition that is “in process” and one that is “complete.” This distinction was originally intended for applicants who had recently begun a gender transition and needed documentation to travel abroad, before the requirement for undergoing a surgical procedure was removed. As there is no longer any requirement to provide medical certification to justify a change in gender marker on a U.S. passport, these limited validity passports should no longer be issued in gender marker change cases.

If you have been previously issued a limited validity two-year passport, you should submit a  completed  Form DS 5504 , Application for a U.S. Passport (Name Change, Data Correction and Limited Passport Book Replacement) to extend to a full validity passport. No additional fee is required unless you request expedited service.

You may mail in your application to the National Passport Processing Center or drop off your completed application and required documentation to your local State Department Office.  Note that any documents you mail in will be returned if not damaged.

Can I update a Consular Record of Birth Abroad?

Yes. A Consular Record of Birth Abroad (CRBA) is the equivalent of a birth certificate for American citizens born abroad. The policy for passports also applies for updating a CRBA. No medical documentation is necessary to request a change to CRBA gender marker.

To Amend a Consular Report of Birth Abroad , You Must Submit:

  • A notarized written (or typed) request detailing the amendment or correction needed;
  • Certified copies of documents justifying the amendment requested, in this case a court ordered name change, if applicable;
  • An original or replacement consular report of birth abroad : any birth record issued from the Department of State such as an FS-240 (for birth after January 3, 2011), replacement FS-240,  Certification of Report of Birth DS-1350 (for birth Nov 1, 1990 - Jan 2, 2011) or Certification of Birth Abroad FS-545 (for birth prior to November 1, 1990); or a notarized affidavit stating the whereabouts of the original or any replacement FS-240, DS-1350, FS-545 issued from the Department of State;
  • A copy of requester’s valid identification;
  • A $50.00 check or money order made payable to “Department of State”. The Department will assume no responsibility for cash lost in the mail.

What If I Face Problems Updating my Passport?

The current policy specifically instructs passport specialists to treat transgender applicants with respect, including using appropriate pronouns and not asking unrelated questions. If you encounter improper requests for information, unprofessional behavior, or other difficulties obtaining a passport, you can call the National Passport Information Center at  1-855-865-7755  to make a complaint or submit a complaint online through the Department of State's Customer Survey . You can also contact NCTE, your Regional Passport Office, or your U.S. Senator’s Office. NCTE is consistently monitoring implementation of this policy.

If you encounter discrimination, harassment or other serious difficulties relating to being transgender while traveling abroad, contact the closest U.S. Consulate or Embassy immediately.

Getting a New Passport for a Child : You cannot renew a passport for a child under age 16. You must apply again in person using Form DS-11.

You can renew by mail if your most recent passport:

  • Can be submitted with your application,
  • Is not damaged (other than normal  wear and tear ),
  • Has never been reported lost or stolen,
  • Was issued within the last 15 years,
  • Was issued when you were age 16 or older, and
  • Was issued in your current name (or you can provide a document like a marriage certificate or divorce decree to show you have changed your name)

If you want to renew a limited validity passport that is valid for less than the normal period of 10 years, you must meet these requirements:

  • One of your previous passports must have been issued for 10 years,
  • Your passport cannot be limited because you’ve lost multiple passports, and
  • Your passport cannot be limited because you’ve had multiple damaged passports

Tips to complete your form:

  • Complete all parts of the form.  Sign and date your form  before you mail it.
  • Print your form on single-sided paper. We do not accept double-sided forms. 
  • Check your date of birth and previous passport issuance date if you did not get the form you expected to receive on the form filler.
  • You can renew a passport book , a passport card , or both documents.
  • Use Form DS-82 to apply for your first passport book if you only have a passport card, or to apply for your first passport card if you only have a passport book.  
  • If you travel many times each year, get a larger passport book with more visa pages, at no extra cost.  Check the 'large book' box at the top of the DS-82.
  • If renewing from Canada, do not include your Canadian Social Insurance Number on the form in place of your U.S. Social Security number. 

Submit your most recent U.S. passport

When you renew by mail or in person, you must submit your most recent passport(s) with your application. We will return your most recent passport book or card in a separate mailing. The most recent passport may not arrive for up to 8 weeks after you get your new passport. Learn below what document to submit based on what you want to renew:

Submit other documents if you are changing your name

If the name you are using is different from the name on your most recent U.S. passport, you must provide a  certified copy of the legal name change  document. Examples include:

  • Marriage certificate
  • Divorce decree
  • Court-ordered name change document

We will return your name change document in a separate mailing from your new passport.

Tips for renewing from Canada :

  • If your Canadian divorce decree does not show that you are returning to your maiden name, you must provide proof of your birth or maiden name. Examples include an original or certified copy of your birth certificate.

You must provide one photo with your application. Go to our  Passport Photo page  for photo requirements and to see examples of photos. You can get a photo at:

  • A company which offers photo services
  • Home. Ask a friend or family member to take your photo. Print it on glossy or matte photo quality paper. 

 Stapling your photo to the application:

  • Use four staples vertically in the corners as close to the outer edges as possible. See example below.

It may take 2 weeks from the day you apply until your application status is “In Process.” 

What is normal "wear and tear" of a passport?

Normal "wear and tear" of a U.S. passport does not count as damage. Normal wear includes:

  • The bend of a passport after you carry it in your pocket
  • Fanning of the visa pages after opening and closing the passport 

If your passport is damaged, you cannot renew it and must apply for a new passport.

Damage includes:

  • Water stains
  • A significant tear
  • Unofficial markings on the data page
  • Missing visa pages (torn out)
  • A hole punch, or other injuries

Can I renew at an acceptance facility?

No. If you are renewing your passport with Form DS-82, acceptance facilities will not take your application. Acceptance facilities should never charge you a $35 fee for renewing your passport. These locations should only charge you a $35 fee if you are applying using Form DS-11.

You must mail in your renewal application (Form DS-82) yourself. Mailing your Form DS-82 can be confusing since some post offices are also passport acceptance facilities. Postal employees should not review your form and supporting documents before you mail it.

Send Form DS-82 and supporting documents using a trackable delivery method.

Do not use UPS, FedEx, or DHL since the address you need to send your Form DS-82 and supporting documents to is a Post Office (PO) Box. 

If I already have a passport book or card, can I use the DS-82 to get the other document?

If you have a passport book  and you are eligible to use Form DS-82, you may apply for a passport card as a renewal by mail even if it is your first  passport card .

If you have a passport card and you are eligible to use Form DS-82, you may apply for a passport book as a renewal by mail even if it is your first passport book. 

Can I send multiple renewal applications in one envelope?

Yes. If your family member or spouse is also renewing a passport, you may want to send multiple applications in the same envelope. You can pay for the applications using one check or money order. Make sure to add up the correct fees for multiple applications. 

How will you send my passport and supporting documents?

You will get multiple mailings. The number of mailings depends on what document(s) you asked for.

Passport Book : You may get your new passport and citizenship documents in two mailings. You may wait 8 weeks after getting your passport before you get a second mailing with your citizenship documents. We will return the passport book using a trackable delivery service.

Passport Card : You may get your new passport card and your citizenship documents in two mailings. You may wait 8 weeks after getting your passport before you get a second mailing with your citizenship documents. We only send the passport card via First Class Mail. We do not send cards using 1-2 day delivery services.

Both a Passport Book and Card : You may get three separate mailings:

  • New passport book
  • New passport card
  • Citizenship documents

Contacting Us : If you have been waiting more than 8 weeks for your documents, call us at  1-877-487-2778  to report that you have not received your documents. 

If you want us to reimburse you for a lost supporting document, you must contact us within 90 days of the date which we mailed your passport. You will also need to provide a receipt to show the cost of replacing the document. 

I got a letter requesting that I resubmit my Form DS-82. What should I do?

When you renew by mail, our intake facility will review your application and supporting documents.

The intake facility will send you a letter if there is a problem with your application. The letter may include a QR code with a link to our website. Common reasons for getting this letter include:

  • No signature or date on your form
  • Bad or missing photo
  • Pages of your form are missing
  • Wrong or missing fees
  • Most recent passport is missing
  • Most recent passport issued over 15 years ago

Follow the instructions in the letter. You must include the letter we sent you when you resubmit the new application. 

When your application is at the intake facility, your application status will show as "Not Available" if you check our Online Passport Status System . Your application will be "In Process" once a passport agency or center begins processing your new application.

Routine:  6-8 weeks*

Expedited: 2-3 weeks and an extra $60*

*Consider the total time it will take to get a passport when you are booking travel.  Processing times only include the time your application is at a passport agency or center.

How do I change my legal name?

Changing your legal name begins with getting a court order. With that court order, you can update your official IDs like your driver's license, birth certificate, passport, and Social Security card so they match who you are.

This is a standard procedure and the court system is only involved to prevent fraud or harm, like changing your name to avoid debts or defame someone.

All name change records are confidential. In 2021, the NJ Supreme Court ordered that all records of name changes be excluded from public access to respect the rights and privacy of transgender individuals. In addition, you DO NOT need to publish your name change request in a newspaper.

Getting a court order involves a few steps: filling out several forms and sending them to the courts online or by mail, paying a $250 administrative fee, and appearing in-person before a judge (detailed instructions below).

For minors, the process is the same, but those under 18 years old must use a different set of forms, which can be found here .

Most name changes can be done by yourself, but you can get a lawyer if you have a complicated criminal or credit history – or if you just want some help navigating the process. Free LGBTQIA+ friendly legal services are available .

Getting A Court Order To Change Your Legal Name

Step 1: fill out court documents.

You will need to complete five forms found in this packet :

  • Verified Complaint: This form provides the court with basic information like your birth name, preferred name, and why you are changing your name. You can write something like: "This is my preferred name and I wish to obtain proper documentation."
  • Certification of Confidential Information for Name Change: This form provides the court with basic, confidential information like your Social Security number.
  • Order Fixing Date of Hearing: This form is used to schedule your hearing at the courthouse. You only need to complete the personal information in the top section of the form. The court will fill out the bottom portion.
  • Final Judgment and Final Judgment Addendum: These forms finalize your name change. You only need to complete the personal information in the top section of the form. After your hearing, the court will sign and complete the bottom portion of these forms, and you can then use certified copies of the Final Judgment to update your official IDs and documents.
  • Civil Case Information Statement (CIS) : This form summarizes your case for the court, but can be a little confusing to fill out. For detailed instructions, refer to this step by step guide from the NJ Courts . Note: The case type number for a name change is 151.

Note: Those under 18 years old must use this set of forms.

Step 2: Pay the Administrative Fee

Make a check or money order payable to "Treasurer, State of New Jersey" for $250 – or you can pay online (see step 3). This is the fee to cover the cost of filing your papers with the courts. If you can show financial hardship, you may not need to pay the fee. To apply for a hardship waiver, complete the Fee Waiver Request Form and send it along with your documents. Note: The Fee Waiver Request requires documentation like pay stubs, welfare documents, unemployment documents, and bank statements.

Step 3: Send Your Documents To The Court

Once you have prepared and carefully reviewed all necessary forms, you will need to send your documents to the Superior Court either online or by mail. Sending your documents online You can submit digital versions of your documents through the NJ Courts' online system . For detailed instructions on how to use the system, visit the NJ Courts JEDS (Judiciary Electronic Document Submission) page . Note: You can pay the filing fee online by credit card, debit card, or ACH transfer.

Sending your documents by mail

Before mailing your documents, remove all instruction sheets, make sure you have signed all the forms wherever necessary, and make copies for your records. In your envelope, make sure to include:

  • Two signed copies of each form (one is for the courts and one is returned to you)
  • A check or money order for $250.00 or a Fee Waiver Request form
  • A stamped envelope addressed to yourself so the court can return your documents.

Once you have everything together, mail your packet to the Superior Court in your county . If you can, use certified mail so you can request a return receipt for proof of delivery.

Step 4: Review Returned Copies

If you mailed your documents, the court will return copies of the Verified Complaint, Certification of Confidential Information for Name Change, and Order Fixing Date of Hearing forms using the self-addressed envelope you provided.

These documents will now have a docket number written on them. This number is important as it identifies your case and you will need to use it on all future papers you send to the court about your case.

Carefully review the Order Fixing Date of Hearing form. It should now have the date filled in. This date is critical as it is the day and time you need to appear before a judge at the courthouse to finalize your case.

If you have pending criminal charges in New Jersey:

  • You must send copies of the Verified Complaint, Certification of Confidential Information for Name Change, and the Order Fixing Date of Hearing forms by certified mail to the prosecutor of the county where the criminal matter is being heard. You must send these forms at least 20 days before your name change hearing.
  • If the Office of the Attorney General brought charges against you, you must send copies of the Verified Complaint, Certification of Confidential Information for Name Change, and Order Fixing Date of Hearing forms by certified mail to the Director of the Division of Criminal Justice at least 20 days before the date of the name change hearing. Use the following address: Director, Division of Criminal Justice R.J. Hughes Justice Complex 25 W Market Street P.O. Box 085 Trenton, NJ 08625-0085
  • After you have mailed the necessary forms using certified mail, the post office will send you a green card. This is your certified mail receipt. Make a copy of the receipt and mail the original along with a completed copy of the Proof of Mailing form ( Form D from this packet ) to the court where you are changing your name. Note: If you are a minor, use Form J from this packet .

Step 5: Go To The Courthouse

Head to the courtroom and see the judge on the day and time listed on the Order Fixing Date of Hearing form. Here's what you can expect at your hearing:

  • The judge may ask you questions about your name change and whether you are trying to avoid debt or a criminal history. This is a routine part of the process.
  • If the judge asks why you want to change your name, you can say this is your preferred name as stated in your application, or you can provide more details if you feel comfortable.
  • If the judge asks about your transition, you can answer if you are comfortable or you can respectfully say that is private medical information. You DO NOT need to provide any personal medical information or documentation for a name change.
  • At the end of the hearing, the judge should sign the Final Judgment form and provide you a copy.

Note: Bring proof of your birth name for identification purposes.

Step 6: Get Certified Copies of the Final Judgment

To legally change your name on your state and federal IDs, you need to order certified copies of your Final Judgment and send them to different agencies. You cannot use photocopies.

To get a certified copy of the Final Judgment form, complete NJ Courts' Records Request Form .

You can submit your completed form through the NJ Courts' online system , email it to [email protected] , or mail it to the following address: Superior Court Clerk's Office P.O. Box 971 Trenton, NJ 08625-0971

Order at least 3 certified copies. The fee for each copy is $25.

Step 7: Update Your State and Federal IDs

With the certified copy of your Final Judgment, you can now update official IDs like your birth certificate, Social Security card, and passport. For detailed instructions on how to update your IDs, refer to these step-by-step guides:

With the NJ Treasury Department Within 45 days of getting your court ordered name change, you must send a certified copy of the Final Judgment and a filing fee of $50 to the NJ Treasury Department's Division of Revenue .

Your copy of the Final Judgment will be returned to you.
