The Goals of Campus Discipline

Considering the system of student discipline in its broadest application, ranging from physical or sexual assault to stolen textbooks and offensive graffiti, it is helpful to identify three distinct goals that a system of campus discipline seeks to achieve. In both practice and theory they are separable yet closely related. Measures that advance one of the three are likely to contribute to the others as well.

To Prevent Exploitation and Harm

The first goal of a system of student discipline is to prevent exploitation and harm to students . Policies and procedures related to student conduct should protect students so far as is reasonably possible from others who would prey on their vulnerability if given the opportunity. This is the foundation for rules prohibiting many kinds of serious misconduct such as theft, physical violence, sexual assault, verbal harassment and denigration, and sale of mind-altering drugs. Academic dishonesty is also a form of exploitation. A student who copies another’s work not only deprives the source of proper credit for her work but also undermines the essential but fragile system of academic evaluation in the institution. By enacting and enforcing policies against exploitation and harm, the university seeks to protect students against others’ malevolence.

What is the moral ground for a university’s concern with preventing harm? No more and no less than our fundamental obligation to protect others from injury, especially in circumstances in which another is vulnerable to harm that could be averted by one’s words and actions. Every ethical system recognizes this basic duty to prevent harm, whether it then traces the ultimate ground of this obligation to a Kantian conception of autonomy and universalizability , an Aristotelian concept of virtuous habits forming a virtuous character, a theological concept of the respect due to all created persons, or a morality based on the weighing of good and bad consequences.

Those who govern an institution such as a university have the same duty to protect others that applies to them as individuals. But their official capacity to set policies and direct practices on campus greatly enlarges the consequences of their actions and therefore their responsibility to act. Of course, it is impossible to prevent all harmful and hurtful acts committed by members of an academic community or of any other community. But a carefully framed and rigorously enforced policy regarding physical assault, for example, may deter many attacks that would have occurred under circumstances of institutional laxness and inattention.

The primary goal of campus rules of conduct is to prevent students from harming fellow students. The reason is not that students are more prone to misconduct than outsiders. Indeed, they are surely less likely to injure each other intentionally than are a random collection of individuals, since their shared status as students contributes to a sense of common purpose and their shared participation in campus life makes them something more than strangers to each other. Only students, however, are directly answerable to the institutional code of conduct. Campus disciplinary officers can impose potent disincentives to deter students from harming others and a range of sanctions if they do. Their authority over outsiders is far more limited.

Note the overlap, but also a great deal of difference, between what is legitimately prohibited in a campus environment and what is prohibited by law. Actions liable to criminal prosecution—rape, assault, theft, embezzlement—are not the primary focus of a university disciplinary code. When these crimes occur on campus, administrators must cooperate with local authorities in conducting an appropriate investigation. Universities should remind students that living on campus is not living outside the law. Students gain no immunity from criminal law and surrender none of the protections of those charged with breaking the law.

Prevention of crime should be a priority, all the same, in other aspects of the life of a university. Building design, campus lighting and landscaping, student transportation options, and the work of campus safety officers can greatly enhance the safety of students and reduce the incidence of violent crime. This is not the domain of disciplinary codes but an important contribution to their effectiveness.

Students are especially vulnerable to some sorts of harm that fall outside—or just at the borders of—the criminal code. The possibility that one’s work will be stolen and used dishonestly, for example, is an inherent risk in any academic enterprise. Undergraduates, graduate students, and established researchers sometimes succumb to this temptation. Some institutions, including many elite undergraduate colleges and the nation’s military academies, seek to combat plagiarism through promulgation of an honor code to which all students must subscribe. Others disseminate detailed guidelines that distinguish legitimate from illegitimate borrowing in academic research and writing. Studies that I reviewed in writing my book on student conduct indicated that neither system was, in general, more effective than the other. A newly drafted honor code, however, seems to be less effective than one that has long been part of campus culture.

Consider too the issue of acquaintance rape. It is by no means unique to university communities, but the close personal relationships and powerful peer pressures that obtain in college, together with ready availability of alcohol, heighten the danger of such assault. Whenever one person is induced to engage in sexual activity through coercion or threats, a sexual assault has occurred. But campus cultures too often discount the testimony of victims and give too much credence to an assailant’s assertion that the act was entirely consensual.

The rules for responding to allegations of sexual harassment in educational settings have become a contentious issue as three U.S. administrations sought to interpret the requirements of Title IX of the Higher Education Act, which guarantees equal treatment and protection against harassment. In brief, the Department of Education under President Obama issued guidelines for investigating and adjudicating allegations of abuse that were intended to uphold victims’ rights and remove impractical evidence requirements, but under President Trump new guidelines were issued that set a higher standard for evidence of wrongdoing and allowed alleged perpetrators to question anyone testifying against them. Under President Biden, as a major policy review moves forward, the last requirement was revoked in August 2021. Universities will no longer be required to allow the accused to cross-examine the complainant, and more extensive revisions are expected soon.

In many cases of plagiarism and acquaintance rape, no laws have been broken, so victims cannot call on the police or the courts to come to their assistance. Copyright laws are not intended to apply to unpublished work by students. Criminal penalties for rape are severe, but the circumstances of acquaintance rape make it difficult for the victim to prove that an assault has occurred and easy for the guilty to escape punishment. Institutions have a special obligation to address the issues of cheating and sexual assault because there is little likelihood of legal redress for these harms imposed by some students on other students.

The same is true of the prevention of alcohol abuse and illegal drug use. No academic community can hope to be entirely free from such practices, which are widespread on campus and off. But the intense social pressures that bear on students in a campus setting need to be balanced by clear and firm campus rules, backed by effective measures of enforcement and consistent penalties when violated.

The aim of averting harm is inevitably to a certain extent paternalistic. The university no longer claims to be a moral arbiter standing in loco parentis , an institutional chaperone guiding young men and women on the path of virtue. With rare exceptions, no institution today wants to reclaim this role, and in any case, students would not tolerate it. The college’s concern, however, is not limited to protecting students against harm done to them by others. It extends also to protection of students against themselves, antiquated and condescending as that phrase may sound today.

The harm of drug and alcohol abuse is suffered primarily by the individual who engages in such behaviors, not inflicted on others. All the same, it is a serious form of harm and a legitimate concern of a university, not merely because it is likely to be a contributing factor in other graver harms, such as physical injury and, especially in the case of alcohol, sexual assault. Diminished capacity for academic work and for responsible behavior due to such substance abuse is itself a harm to the individual and to others that the institution should seek to prevent.

An institution places itself in a position very similar to that of a parent in saying to students: We seek to protect you from grave harm, even when you bring it upon yourself and would suffer it willingly. The goal of disciplinary rules in this instance is to deter students from acting in a way that amounts to an assault against themselves and a diminishment of their future prospects. In my study of student discipline I suggested, with tongue in cheek, that institutions that want to disavow their role in loco parentis as a vestige of the distant past might adopt a change to the metaphor. Consider the difference between advice given by a parent and that offered by a grandparent, for example, which is likely to be less directive and more empathetic. Or think about how one might intervene to dissuade a niece or nephew from making foolish choices, knowing that one cannot directly tell them how to behave but can expect them to consider one’s counsel seriously. Perhaps today the university should stand in loco avi (in place of a grandfather), then, or in loco avunculi (in place of an uncle). Although not as familiar as the parental variant, these Latin phrases may be more appropriate.

So much for prevention of harm. To acknowledge this first goal and no others, however, would be to confuse the function of the entire system of student discipline with that of a campus security department. Colleges and universities also pursue two additional goals no less important to the life of the institution.

To Promote an Atmosphere of Dialogue and Debate

A second essential goal of student conduct rules is to sustain an environment conducive to free discussion and mutual learning. The campus is not merely a place where students can go about their lives and studies relatively free from fear of assault and exploitation. It is also characterized by free and open exchange of ideas, arguments, and ideologies. A university is a place for vigorous debate of issues important to students and their communities, where ruling orthodoxies confront new evidence and new interpretations. Even one’s most cherished beliefs and ideals are open to challenge and possible revision in a healthy academic environment.

The moral ground of this second purpose is different from that underlying the first, but it too is a principle widely embraced: A healthy community grants its members as broad a range of personal and political freedom as is consistent with respect for the rights and the liberties of others. Although similar ideals of religious and intellectual freedom motivated the founding of the United States, they have frequently been compromised because of the pressures of social conformity. From their inception, universities have held themselves up as beacons for a broader vision of freedom. Yet there is a continual struggle on many campuses between the ideal of free and open discourse and the tendency of institutions to adopt and enforce an official ideological vision.

Cultural critics on the political right make this point frequently and stridently. They allege that universities pay only lip service to academic freedom and open dialogue while imposing a stultifying intellectual orthodoxy. Instructors who venerate Marx and Foucault and scorn Friedman and Hayek, they claim, force-feed students a diet of socialism, secularism, and radical feminism. Conservative voices are silenced or scorned.

Are these allegations accurate? Surveys of the political leanings of college and university faculty do indeed show a tilt to the left but not an absence of voices on the right. In a 2006 survey, 44% of faculty respondents identified as liberal, 46% as moderate, and 9% as conservative. Periodic surveys of undergraduate faculty conducted by the Higher Education Research Institute at UCLA show, over recent decades, greater numbers calling themselves “liberal” and “far left” than “conservative” and “far right.” In the 1990s, the largest number selected “moderate/middle of the road,” followed by a shift to the left and then, in the most recent surveys, a shift back to the center. One notable finding in 2016–2017 was a substantial increase in those choosing “encouraging students to think and act critically” as an important priority.

Allegations of liberal bias also highlight campus agitation against controversial speakers. In 2016 conservative watchdog groups counted forty-three incidents in which students and faculty demanded “disinvitation” of speakers, most of them identified with the political right. But only half these efforts succeeded. Moreover, according to a nonpolitical organization, by 2018 the number of such incidents had dropped to just nine, five of them successful. The organization also noted that, where twenty-eight faculty members had been dismissed or demoted in 2017 for inappropriate political speech, that number dropped to just eight in 2018, four of them targeted by conservatives and three by liberals.

Conservative perceptions of a liberal stranglehold on campus are unfounded. And yet the right’s critique of campus culture serves as an important reminder that free and open discourse requires active monitoring and vigilant defense. On every campus, some factions seek from time to time to silence others, and the danger that a ruling orthodoxy will stifle dissent is never wholly absent. Claims that a particular party line has gained the ascendency on the nation’s campuses, whether that be an ideology of the left or the right, Marxism or libertarianism, should provoke our skepticism. All the same, the atmosphere of openness and readiness to listen to others who hold sharply different views is a rare and fragile thing, not just on campus but in other communities as well. It needs to be nurtured and defended against social and political pressures that threaten it.

The goal of upholding freedom of thought and expression mandates broad discretion for students—and faculty members—in planning debates, inviting speakers, publishing opinions in campus newspapers, and the like. Some student codes of conduct underscore the importance of these provisions by including a formal “bill of student rights” in their discipline code, setting out the extent of students’ freedom to speak and act.

The goal of facilitating open discourse entails another objective with which it might appear initially to be in conflict: minimizing the incidence of abusive and degrading speech and writing. Conflict does occur between these two objectives, but it need not. If carelessly and vaguely written, a speech code intended to prohibit racial and gender abuse can cast a pall over discussion of controversial issues and deter open expression of unpopular ideas. Disciplinary rules need to target precisely those rare sorts of abusive speech that cast some out of the community of discourse and treat them as less than human. If narrowly worded and carefully framed, hate speech policies contribute to an environment conducive to learning and constructive discourse, barring the door only to those who by their very choice of words would exclude others on the basis of race, gender identity, or sexual orientation.

Upholding an atmosphere conducive to free and honest discourse has implications in what might appear to be an unrelated realm, that of on-campus housing. Clear rules, consistently applied, concerning alcohol use and overnight guests in residence halls contribute to an ethos in which students’ social and academic lives are closely integrated, each supporting and advancing the other. Absence of such rules, on the other hand, or their effective absence owing to lax or inconsistent enforcement, makes residence halls essentially useless for purposes of study, especially in evening hours. On far more campuses than the admissions brochures and student life administrators acknowledge, drinking and partying and hooking up in dorm rooms effectively opens a wide gulf between the academic enterprise and the social community in which students live. Not only does it impede academic study, it also inhibits thoughtful political and intellectual discourse.

What sorts of regulations are appropriate in student housing? The traditions and the character of a particular institution make it difficult to generalize, as does the architecture of student housing. A building with a separate wing for study, well away from social gathering spaces, poses fewer challenges than a complex of small rooms. The parietal rules of earlier generations rested on moral dogmas that students might have rejected if asked. But we need not invoke an outmoded moralism to justify promoting a healthy environment for learning.

In effect, student life staff today are invoking old means to new ends. No campus administrators claim the prerogative of acting in loco parentis to prohibit drinking and cohabitation today. But if they do not set some rules for student life—acting in loco avunculi, like a concerned but not controlling uncle—then students must live in what are merely and literally “dormitories,” places for sleeping and partying but not for studying or serious conversation. To leave students to behave as they will without restriction in on-campus housing is not merely to set aside the moralistic ambitions of an earlier era but to compromise the obligation of the university to maintain an atmosphere for students in which study and learning can flourish.

An interesting trend has emerged recently in campus housing: more and more campuses offer options for “substance-free housing,” residence halls whose residents promise not to use tobacco, alcohol, or recreational drugs. One source lists forty institutions offering this option, implicitly acknowledging that discipline codes alone do not guarantee an environment conducive to study, and no doubt there are many more. I have not found any studies assessing the effectiveness of offering such options—how many students choose them and how well they comply with the rules. On online forums, some students say they are glad to be in environments free from wild parties, but others say the wildest parties on their campuses tend to happen in the supposedly substance-free halls. Clearly much depends both on student compliance and on institutional oversight.

To Nurture a Sense of Community

A third essential goal of student conduct regulation is to instill a sense of mutual responsibility and moral community in students. This third aim is both more comprehensive and more controversial than the first two. Some would reject it as extending beyond the proper function of a modern university, which should stick to academics and not meddle in the private affairs and personal relationships of its students. But to neglect this third purpose would be an abdication of a critical responsibility of the college and university.

Formation of character was once upheld as a central, if not the primary, purpose of higher education. This tradition is honored rhetorically in the preamble to many a college catalog, where the language of character, citizenship, and moral community is laid on with a trowel. Yet today few colleges, and even fewer universities, take their own lofty rhetoric seriously in planning their programs, hiring new faculty, or shaping general education requirements.

A typical college of the eighteenth or nineteenth century made the behavior of students its business and sought to inculcate moral virtue, which a majority of institutions grounded in religious orthodoxy of one sort or another. In the 1860s, to cite one example, the student conduct code at Harvard was forty pages long. Many college presidents of that era taught a required course in ethics for graduating seniors.

A typical college or university of the twenty-first century proclaims its lofty goals of training responsible and engaged citizens and promoting a sense of moral and social accountability only in the first few pages of the catalog and in fundraising appeals to alumni, while its actions carry another message entirely. I do not intend to suggest that moral growth does not occur in universities, of course. Every issue of every alumni magazine highlights glowing testimonials to the inspiring example of instructors who opened students’ eyes to the pressing problems of the nation and the world, leading them into careers in public health or community development. Faculty and their employers can take pride in such stories.

But these stories may not reflect the operating principles of the institution. Indeed, they may result from the readiness of some faculty and administrators to defy an institutional culture of individualism and careerism. At many institutions the core message that can be discerned, in faint letters behind the inflated rhetoric of marketing brochures, might be summarized thus: “We hire excellent scholars for the faculty, we maintain a fine library and provide access to a world of online resources, we cherish our sports teams’ trophies, we fill the flower beds each year for parents’ weekend, and we sincerely hope that our students will turn out all right.”

Whether graduating seniors are paragons of virtue or cynical opportunists is a matter largely beyond the control of the institution and its faculty. Moral character has been largely shaped before students begin university studies, after all. Even in college, other factors—family, peer judgment, mass media, and personal reflection—are likely to exercise a more profound influence on students’ ethical commitments and sensibilities than will any acts or policies of the institution. For most students, a few faculty members will stand out, even a decade after graduation, as models of both intellectual and ethical integrity, and I do not mean to understate the effectiveness of faculty-student interaction both in and out of the classroom. But matters such as these cannot be effectively mandated by institutional rules or policies. The goal of producing ethical and engaged citizens is simply not realistically attainable by any institution, whatever the preamble to the college catalog may boast.

All the same, the university can and should seek to create a campus atmosphere of respect, openness, critical discourse, and mutual recognition of both rights and responsibilities. Students learn quickly, as much from unspoken signals as from handbooks and speeches, the limits of acceptable behavior. An instructor who overlooks rampant cheating on the first test of the semester cannot expect better behavior on the next one. An institution that takes no effective steps to prevent and punish alcohol abuse tells its students by its inaction that, notwithstanding the lofty ideals in the catalog, they are students at a party school. Conversely, if cribbing and excessive drinking meet firm and consistent discipline, students learn that they will be held responsible for their academic work and for their actions. And the behavior of administrators and faculty members speaks louder than the conduct code.

When students regularly observe their instructors engaging in spirited and open-minded debates with each other and with students over important moral and social issues of the day, they learn that the institution expects more than transmission and acquisition of knowledge. When a controversy over campus policies or governance is resolved through consultation and cooperation among students, staff, and faculty, students’ moral education is advanced, not by a required senior class, or a student handbook, or a presidential dictum ending the debate, but by seeing how the campus community functions. Even in cases where resolution is not reached and controversy continues, the character of a diverse campus community is evident in its modes of discourse.

Modern societies regard moral choices as fundamentally individual decisions. While this ideology has made indispensable contributions to the establishment and protection of a broad range of personal and political liberties, it is grossly inadequate as a description of our moral life and action. We make our choices in social and cultural contexts. Morality is both learned and exercised, above all, in relation to others. This is why a collaborative response to the challenges that confront a campus community is so vitally important: the community itself is the context in which morality arises, is articulated, and is put into practice.

Consider a hypothetical example. Suppose a crisis erupts when members of a fraternity taunt and harass transgender students. Their behavior elicits protests by student groups that serve as advocates for LGBTQ+ students, and then those protests provoke counterprotests from other fraternities. What should be done? Should the students responsible for the initial incidents of harassment be punished? Or should students work out their differences without interference from student life staff?

To allow such behavior to pass without comment suggests that the university either approves or tolerates behavior that falls far below a minimum standard of mutual respect. To do and say nothing is in effect to accept the fraternity members’ judgment that trans students are not deserving members of the student body. But disciplinary action alone, punishing the individuals involved without addressing what lies behind offensive behaviors, is also inadequate.

In a campus community that promotes mutual respect and open dialogue, such an incident might yield a process of deliberation and consultation leading to action more wide-ranging and more lasting than sanctions for a few individuals. In discussions that bring diverse viewpoints into conversation with each other, transgender students and their allies would gain a wider audience for their concerns, not just about isolated incidents of harassment but also about difficulties they face in classrooms, residence halls, and locker rooms. Leaders and members of fraternities would be challenged to identify aspects of their past behavior and rhetoric that made misbehavior more likely and to undertake changes in the future. Everyone who attends to this discussion on campus would learn more about the experience of those who face abuse because of others’ insecurities and fears.

A process in which all voices are heard, and then paths for future cooperation are mapped out, serves as a concrete demonstration that the campus community can face and resolve its problems. The goals of freedom of expression, freedom of association, and regard for the vulnerable may come into conflict. Balancing them requires patience and wisdom. When students participate in or observe a process that airs differences and finds common ground, they do not simply learn to respect differences and stop shouting insults. They learn what it means to be a member of a moral community.

I do not mean to suggest that every incident of petty harassment warrants such a full-court response. Context is crucial. An isolated incident on a campus where LGBTQ+ students feel fully a part of the community may offer no reason for alarm or for a public response. At the other extreme, if a pattern of repeated and damaging attacks on a campus minority becomes evident on campus, what is needed is a prompt and firm disciplinary response, prompting measures such as suspension and restitution, not an extended dialogue between offenders and victims. In incidents that fall between these extremes, however, what is initially no more than an unpleasant incident can be the catalyst for a vivid demonstration of how a healthy moral community on campus resolves problems.

Unique in American society, the community of learning that exists on campus—both intellectual and moral—is threatened from within and without. The suspicions of legislatures and anxious parents, the economic and political agendas of private and public donors, and the social-media carping of uninformed critics all seek to limit campus freedoms. No less grave a threat to the health of the campus community are the temptations that draw faculty and students themselves into a narrow vision of higher education, lapsing into individualism, careerism, and social and political apathy.

Nurturing an effective community conducive to moral growth is a vital third goal of student discipline systems, in addition to the prevention of harm and the facilitation of free and open dialogue. It is a worthwhile exercise on any campus to assess the effectiveness of rules, enforcement provisions, and daily practices in advancing each of these three objectives.

Discipline is something that we have all experienced personally in different forms, seen used on others, and is also something that many of us will go on to use later in life, both in the form of self-discipline and as something to keep children and even employees in check. It is essential to life as we know it, and we need it in its many different forms in many different situations.

The first reason that discipline is so important is that we all need to exercise self-discipline to be successful in life. Self-discipline can mean very different things to different people; for students, for example, self-discipline is often about motivating yourself and making yourself concentrate on your studies and get your assignments in on time. For working people, it can be as simple as getting up on time every morning, however tired you may be and how much you may hate your job, getting to work on time and doing your job. Without this kind of self-discipline, people would not be able to enjoy academic success, or be successful in their careers either.

Self-discipline is also required for dieters and anyone doing regular exercise, because given the chance, most of us would prefer to be lazy rather than get up and exercise, and eat burgers and fries rather than healthy food. Without it, even more people would be fat and unhealthy, and a lack of self-discipline in some people certainly contributes to the obesity crisis.

Discipline is also something that needs to be used on others where necessary. If parents didn’t discipline their children when they were naughty, children wouldn’t grow up knowing right from wrong, or be able to become productive members of society who contribute to the system. Equally, schoolteachers need to be able to dish out punishments to children who don’t behave themselves. Without discipline in the classroom, there would be a great deal of disruption and nobody would ever learn anything. Indeed, teachers who struggle to command the respect of students and who fail to use discipline effectively will often have trouble even making themselves heard in a classroom.

In the workplace, discipline is also essential to maintaining a hierarchy and dealing with employees who do not follow company policies and procedures, regularly arrive late or not at all, or treat their co-workers unfairly. Then, you have to consider that without discipline, there would be no law enforcement. Murderers would be roaming the streets and everybody would be stealing from each other, because there would be no consequences for their actions.

Discipline acts as a vital deterrent to stop children being naughty, people from missing work, and even potential criminals from stealing and killing, and for this reason it is vital in human society.

Nowadays, respect has deteriorated and most of the teachers are young. Discipline management in situations where leaders are not respected is sort of impossible.

Economic difficulties also contribute to ineffective discipline managements. Due to increase in population, management of discipline is hard because misbehavior incidences increase due to poverty and discipline management is compromised through these economic hardships. There are also less resources to use in discipline management.

Disruptive behavior of the leader causes ineffective discipline management. Disruptive behaviour of leaders is in the form of lack of interest in the activities of the subjects and the lack of commitment in improving the behaviour of their subjects. IDEA promotes research-based practice . The importance of evidence-based discipline policies is highlighted in the IDEA Amendments of 1997 that govern services to students with disabilities. To support students with disabilities who exhibit challenging behaviors, IDEA requires the consideration of ‘positive behavior interventions, strategies and supports’ when a student’s behavior ‘impedes his or her own learning or that of others.’ The amendments apply not only to direct implementation of supports for individual students, but also address the broader issues of school safety and climates conducive to learning for all students.? Systemic changes in a school’s or district’s approach to discipline and behavioral intervention, including collaboration with families and community agencies, can significantly impact school climate and student learning.? Schools implementing effective strategies have reported reductions in office discipline referrals by 20-60%; this results in improved academic engaged time and improved academic performance for all students. All students, both with disabilities and without, can benefit from proactive behavioral support systems .

Research indicates that effective implementation of proactive behavioral supports includes:

  • Culturally competent, family-friendly behavior support.
  • A focus both on prevention of problem behaviors and early access to effective behavior support.?
  • Implementation with sufficient intensity and scope to produce gains that have a significant and durable impact on behavior.
  • For individual students, an assessment, including a Functional Behavior Assessment, conducted when the problem behavior is first observed or as a proactive activity.

Examples of effective proactive behavioral strategies. There are a number of research-based approaches to providing proactive systems of behavioral support in schools, including Positive Behavior Support (PBS), violence prevention programs, social skills instruction and school-based mental health services. These strategies include:

  • Violence prevention : The most frequent components of a violence prevention program include a prevention curriculum; services from school psychologists, counselors or social workers; family and community involvement; and implementation of effective school-wide discipline practices.? Some examples of proven programs include: Second Step and Promoting Positive Thinking Strategies (see below).
  • Positive behavioral supports and social skills training: : Interventions that help students with emotional/behavioral disorders and social skills deficits have potential to significantly improve school-wide behavior and safety.? Effective programs include: Stop and Think (Project ACHIEVE) and Positive Behavioral Interventions and Supports (PBIS).
  • Early intervention : Interventions that target low levels of inappropriate behavior before they escalate into violence can significantly reduce the need for harsh consequences later. Examples of proven practices include First Step to Success (kindergarten) and Positive Adolescent Choices Training (developed for African American youth).
  • In-school suspension , when focused on continuing the curriculum, while therapeutically debriefing to identify and eliminate the root cause of an acting-out episode, provides an alternative to exclusion.
  • Adult mentors who work with students to help to improve self-concept and motivation to engage in appropriate behavior.
  • Teacher support teams ? (or ‘Intervention Assistance Teams’) evaluate both class climate and student needs, and provide support and strategies to engage difficult students as a prevention effort.

Alternative Educational Settings Support Academic and Behavioral Success

Not all significant behavior problems can be adequately addressed through proactive behavioral support strategies, given the range of causal factors and more immediate concerns for student safety. However, removing students from needed educational services through suspension or expulsion is not the answer. Students who need to be removed from the regular education setting for even a short time should have access to appropriate instruction. The IDEA regulations specify an alternative to discontinuing the educational services of students with disabilities through implementation of Interim Alternative Educational Settings (IAES). An IAES is a temporary, short-term setting, and must: (1) enable the student with disabilities to continue to progress in the general curriculum, although in another setting, and to continue to receive those services and modifications that will enable the child to meet the goals set out in the IEP; and (2) include services and modifications to address the behavior (e.g., possession of a weapon or drugs, the threat of injurious behavior) and prevent its recurrence. IAES can only be implemented through the Individualized Education Team process, in certain circumstances, following procedures established by IDEA regulations (Bear, Quinn, & Burkholder, 2001).

Characteristics of effective alternative programs , identified through research , include:

  • Low staff to student ratio with highly trained, culturally diverse staff
  • Strong component of parent and community agency involvement
  • Use of nontraditional instruction, adapted curriculum and flexible staff roles
  • Sufficient funding and resources to implement program
  • Sensitivity to individual and cultural differences
  • Clear program and student goals
  • Onsite counseling services
  • Multidisciplinary case management
  • Research-based interventions
  • Formative and summative program evaluation

Emerson College won’t discipline arrested students for protest, president says

E merson College will not take disciplinary action against students arrested as part of a pro-Palestinian protest encampment that was dispersed by Boston police last week, its president said in a letter to the college community Sunday.

Over 100 protesters were arrested in downtown Boston’s Boylston Place alleyway in the early morning on Thursday, Boston police said previously. The demonstrators were part of an encampment protest against the war in Gaza by the student organization Students for Justice in Palestine.

Those arrested in the public alleyway face “a series of charges,” including disturbing the peace and unlawful assembly, police said. But in his letter Sunday, Emerson College President Jay Bernhardt said he will encourage the Suffolk County District Attorney’s Office to drop charges related to city ordinance violations stemming from the encampment.

It is unclear whether this plea would include a request to drop charges related to a physical clash some demonstrators had with police during the arrests. Four Boston police officers were injured during the confrontation, police said previously. One was seriously injured, and the others had minor injuries.

Videos of the arrests posted to social media show dozens of Boston police officers — many of them dressed in riot gear — arriving at the encampment around 1:45 a.m. Thursday. A line of protesters can be seen holding umbrellas and trying to block the officers’ entry into the alleyway. Police are then shown ripping the umbrellas from the demonstrators’ hands.

In addition to forgoing disciplinary action against arrested students, Bernhardt said the college will provide housing for students who are required to stay in the city for court appearances after their dorms close. In the letter, he characterized these measures as “initial steps toward healing and growth.”

“The College has done its best to keep all community members safe every day during these challenging times, but we recognize that we must do more,” Bernhardt wrote. “Our leadership team is committed to redoubling our efforts, engaging and respecting all voices across our community, and actively listening and learning how to move forward together.”

The college president also asserted that Emerson “made every possible effort to avoid confrontation between the police and the protesters at the encampment.” Before police stepped in, the college spent days convincing law enforcement and city officials to delay the removal of the encampment.

Then, when it became clear that the city intended to clear the tents from the alley, Emerson “encouraged” the protestors to remove them to prevent arrests and “strongly and directly advocated” for the peaceful removal of the tents without arrests, Bernhardt said. Since then, the college has sent staff to all the precincts where students are being held and posted bail for arrested students.

“It takes immense bravery to speak out and act in support of a cause,” the college president wrote. “As an institution, the College may not take positions on global conflicts, but our overarching goal is for Emerson to be unyielding in our support for our students’ education and their ability to find and express their voices.”

Bernhardt previously acknowledged the “adverse impact” of the arrests on the college community. This is the second time in the last two months that Emerson students have been arrested during a pro-Palestinian protest.

On Saturday, over 100 demonstrators that were part of a student-organized pro-Palestinian encampment protest were arrested on Northeastern’s campus . The university claimed that police were called in because outside organizers had “infiltrated” the protest and antisemitic rhetoric heard at the protest — such as the phrase “kill the Jews” — had crossed a line.

But students that were part of the protest said they believed the majority of the demonstrators were students, and a reporter who had covered the protest wrote on social media that it was likely a pro-Israel counter-protester that had provocatively yelled the violent phrase.

Both student encampment protests were inspired by a protest at New York City’s Columbia University earlier this month. Over 100 people were also arrested at Columbia’s student demonstration.

Open Letter to College and University Presidents on Student Protests

A faculty rally in favor of academic free speech is held in the main quad at Columbia University in New York.

Dear College and University Presidents:

We write in response to the recent protests that have spread across our nation’s university and college campuses, and the disturbing arrests that have followed. We understand that as leaders of your campus communities, it can be extraordinarily difficult to navigate the pressures you face from politicians, donors, and faculty and students alike. You also have legal obligations to combat discrimination and a responsibility to maintain order. But as you fashion responses to the activism of your students (and faculty and staff), it is essential that you not sacrifice principles of academic freedom and free speech that are core to the educational mission of your respected institution.

The ACLU helped establish the right to protest as a central pillar of the First Amendment. We have defended those principles for more than a century. The First Amendment compels public universities and colleges to respect free speech rights. And while the Constitution does not apply directly to private institutions, academic freedom and free inquiry require that similar principles guide private universities. We approach this moment with appreciation for the challenges you confront. In the spirit of offering constructive solutions for a way forward, we offer five basic guardrails to ensure freedom of speech and academic freedom while protecting against discriminatory harassment and disruptive conduct.

Schools must not single out particular viewpoints for censorship, discipline, or disproportionate punishment

First , university administrators must not single out particular viewpoints — however offensive they may be to some members of the community — for censorship, discipline, or disproportionate punishment. Viewpoint neutrality is essential. Harassment directed at individuals because of their race, ethnicity, or religion is not, of course, permissible. But general calls for a Palestinian state “from the river to the sea,” or defenses of Israel’s assault on Gaza, even if many listeners find these messages deeply offensive, cannot be prohibited or punished by a university that respects free speech principles.

These protections extend to both students and faculty, and to speech that supports either side of the conflict. Outside the classroom, including on social media, students and professors must be free to express even the most controversial political opinions without fear of discipline or censure. Inside the classroom, speech can be and always has been subject to more restrictive rules to ensure civil dialogue and a robust learning environment. But such rules have no place in a public forum like a campus green. Preserving physical safety on campuses is paramount; but “safety” from ideas or views that one finds offensive is anathema to the very enterprise of the university.

Schools must protect students from discriminatory harassment and violence

Second , both public and private universities are bound by civil rights laws that guarantee all students equal access to education, including Title VI of the Civil Rights Act. This means that schools can, and indeed must, protect students from discriminatory harassment on the basis of race or national origin, which has been interpreted to include discrimination on the basis of “shared ancestry or ethnic characteristics,” or “citizenship or residency in a country with a dominant religion or distinct religious identity.”

So, while offensive and even racist speech is constitutionally protected, shouting an epithet at a particular student or pinning an offensive sign to their dorm room door can constitute impermissible harassment, not free speech. Antisemitic or anti-Palestinian speech targeted at individuals because of their ethnicity or national origin constitutes invidious discrimination, and cannot be tolerated. Physically intimidating students by blocking their movements or pursuing them aggressively is unprotected conduct , not protected speech . It should go without saying that violence is never an acceptable protest tactic.

Speech that is not targeted at an individual or individuals because of their ethnicity or national origin but merely expresses impassioned views about Israel or Palestine is not discrimination and should be protected. The only exception for such untargeted speech is where it is so severe or pervasive that it denies students equal access to an education — an extremely demanding standard that has almost never been met by pure speech. One can criticize Israel’s actions, even in vituperative terms, without being antisemitic. And by the same token, one can support Israel’s actions in Gaza and condemn Hamas without being anti-Muslim. Administrators must resist the tendency to equate criticism with discrimination. Speech condoning violence can be condemned, to be sure. But it cannot be the basis for punishment, without more.

Schools can announce and enforce reasonable content-neutral protest policies but they must leave ample room for students to express themselves

Third , universities can announce and enforce reasonable time, place, or manner restrictions on protest activity to ensure that essential college functions can continue. Such restrictions must be content neutral, meaning that they do not depend on the substance of what is being communicated, but rather where, when, or how it is being communicated. Protests can be limited to certain areas of campus and certain times of the day, for example. These policies must, however, leave ample room for students to speak to and to be heard by other members of the community. And the rules must not only be content neutral on their face; they must also be applied in a content-neutral manner. If a university has routinely tolerated violations of its rules, and suddenly enforces them harshly in a specific context, singling out particular views for punishment, the fact that the policy is formally neutral on its face does not make viewpoint-based enforcement permissible.

Schools must recognize that armed police on campus can endanger students and are a measure of last resort

Fourth , when enforcement of content-neutral rules may be warranted, college administrators should involve police only as a last resort, after all other efforts have been exhausted. Inviting armed police into a campus protest environment, even a volatile one, can create unacceptable risks for all students and staff. University officials must also be cognizant of the history of law enforcement using inappropriate and excessive force on communities of color, including Black, Brown, and immigrant students. Moreover, arresting peaceful protestors is also likely to escalate, not calm, the tensions on campus — as events of the past week have made abundantly clear.

Schools must resist the pressures placed on them by politicians seeking to exploit campus tensions

Finally , campus leaders must resist the pressures placed on them by politicians seeking to exploit campus tensions to advance their own notoriety or partisan agendas. Recent congressional hearings have featured disgraceful attacks by members of Congress on academic freedom and freedom of speech. Universities must stand up to such intimidation, and defend the principles of academic freedom so essential to their integrity and mission.

The Supreme Court has forcefully rejected the premise that, “because of the acknowledged need for order, First Amendment protections should apply with less force on college campuses than in the community at large.”

“Quite to the contrary,” the court stated, “the vigilant protection of constitutional freedoms is nowhere more vital than in the community of American schools.” In keeping with these values, we urge you to resist the temptation to silence students or faculty members because powerful voices deem their views offensive. Instead, we urge you to defend the university’s core mission of encouraging debate, fostering dissent, and preparing the future leaders of our pluralistic society to tolerate even profound differences of opinion.

Say you’re a college senior, just a few weeks from graduation. For as long as you can remember—even back in high school, before you set foot on campus—older people have talked about free speech. More specifically, older people have talked about free speech and you : whether your generation understands it, whether you believe in it, whether you can handle it.

After watching some of those same people order crackdowns on campus protests over the past few days, you might have a few questions for them.

Last week, from New York to Texas, cops stormed college campuses clad in riot gear. They weren’t there to confront active shooters, thank goodness, or answer bomb threats. Instead, they were there to conduct mass arrests of students protesting the war in Gaza.

As the legal director of a First Amendment advocacy nonprofit, I teach students across the country that the government can’t silence speakers because of their beliefs, even—and perhaps especially—if those beliefs are unpopular or cause offense. That’s a foundational principle of free-speech law. But many of the crackdowns appear to be a direct reaction to the protesters’ views about Israel.

After sending a phalanx of state law-enforcement officers into the University of Texas at Austin campus, for example, Governor Greg Abbott announced on X that students “joining in hate-filled, antisemitic protests at any public college or university in Texas should be expelled.”

But no First Amendment exception exists for “hate-filled” speech. And for good reason: In our pluralistic democracy, everyone has their own subjective idea of what, if any, speech is too “hateful” to hear, making an objective definition impossible. And empowering the government to draw that line will inevitably silence dissent.

At UT, the officers arrested scores of protesters for “ trespassing .” But the students don’t appear to have violated school rules. And you can’t trespass on a place where you have the right to be, as students at the public universities they attend clearly do. Even a cameraman for a local news station was tackled and arrested . The next day, the Travis County attorney’s office dropped all of the trespassing charges for lack of probable cause—a telling indicator of the disturbingly authoritarian response. (Shockingly, the cameraman does face a felony charge , for allegedly assaulting a police officer—an allegation difficult to square with video of his arrest.) The government can’t throw Americans in jail for exercising their First Amendment right to peaceful protest.

Governor Abbott’s illiberal show of force has no place in a free country. It’s especially galling given the governor’s previous posture as a stalwart defender of campus free speech: In June 2019, he signed a law prohibiting Texas’s public colleges and universities from shutting down campus speakers because of their ideology. So much for that.

Governor Abbott isn’t alone. During her congressional testimony earlier this month, Columbia University President Minouche Shafik pledged investigations of students and faculty who voiced allegedly anti-Semitic criticism of Israel and Zionism, and agreed—on the fly—to remove a professor from his position as a committee chair because of his speech.

Columbia is a private institution, so it isn’t bound by the First Amendment. But the university promises freedom of expression to its students and faculty—and Shafik’s willingness to sacrifice faculty and student rights to appease hostile members of Congress betrays those promises.

If such things had happened only at UT and Columbia, that would be bad enough—but the problem is spreading. At Emory University, in Atlanta, police officers reportedly used tear gas and Tasers against protesters. State troopers with rifles directed toward protesters stood watch on a rooftop at Ohio State University. At Indiana University, administrators rushed out a last-minute, overnight policy change to justify a similar show of force from law enforcement, resulting in 34 arrests. It’s hard to keep up.

Students nationwide are watching how the adults who professed to care about free speech are responding under pressure. And they are learning that those adults don’t really mean what they say about the First Amendment. That’s a dangerous lesson. Our schools and universities could still teach the country a better one.

“Free Speech 101” starts here: The First Amendment protects an enormous amount of speech, including speech that some, many, perhaps most Americans would find deeply offensive. You may not like pro-Palestine speech; you may not like pro-Israel speech. You may think some of it veers into bigotry. The answer is to ignore it, mock it, debate it, even counterprotest it. But don’t call in the SWAT team.

Granted, free speech is not without carefully designated exceptions, and these exceptions are important but narrow. True threats and intimidation, properly defined, are not protected by the First Amendment. Neither is discriminatory harassment. Violence is never protected.

And public universities can maintain reasonable “time, place, and manner” restrictions on speech. That means, for example, that for the authorities to place a ban on playing heavily amplified sound right outside the dorms at 2 a.m. likely does not violate the First Amendment. A prohibition on camping overnight in the quad probably doesn’t either. And taking over a campus building, as Columbia students did early this morning , is not protected.

But the enforcement of these rules must be evenhanded and proportionate. The use of force should be a last resort. Students must be given clear notice about what conduct crosses a line. And any student facing punishment for an alleged infringement should receive a fair hearing. Consistency counts. Our leaders—in government, in university administration—must demonstrate their commitment to free expression in both word and deed.

Students are protesting on campuses nationwide, and they’re watching the reaction of university presidents and elected officials closely. The current moment presents a generational challenge: Do older people and people in authority really mean what they say about the First Amendment? Do they believe in free speech—and can they handle it? Right now, too many leaders are failing the test.

Emerson College said students involved in last week's pro-Palestinian protest encampment will not face any discipline from the school.

According to a Boston police report, a total of 118 people were arrested on a charge of disturbing the peace when an encampment in a public alley near Emerson College was cleared last week by police.

"The College will not bring any campus disciplinary charges against the protesters and will encourage the district attorney not to pursue charges related to encampment violations," the college said in a statement.

The protesters' arraignment dates have been set for May 2. 3 and 7. Emerson's student housing ends on May 3.

"We will also provide housing support to students required to stay in town for court appearances following the closing of their dorms," the college said.

The Boylston Place encampment was one of several set up by students at Massachusetts colleges to show solidarity with the pro-Palestinian protesters who were arrested at Columbia University in New York and to call for their institutions to divest from companies that work with Israel.

GW University suspends students involved in protest encampments

Several George Washington University students were suspended Friday after school officials threatened to discipline those who refused to leave a pro-Palestinian encampment protesting the Israel-Gaza war on the downtown Washington campus.

As demonstrations at the campus entered their second day, the private university took a hard line, saying students could face temporary suspension or be administratively barred for refusing requests to relocate after a deadline to clear the area by 7 p.m. Thursday. The deadline went by without police action.

“The individuals who remain on University Yard and any who attempt to join them are trespassing on private property and violating university regulations,” the statement issued Friday morning said. “We will pursue disciplinary actions against the GW students involved in these unauthorized demonstrations that continue to disrupt university operations.”

Encampment organizers posted on social media Friday night that seven student leaders were placed on interim suspension.

Early Friday morning, D.C. police rejected pleas from university officials to clear the encampment , according to two city officials who spoke on the condition of anonymity to discuss sensitive police operations, adding they had no immediate plans to clear the area known as University Yard along H Street between 20th and 21st streets NW if the situation remained static.

Police said in a statement that the university has asked for their support and that police “will continue to monitor the situation.”

The new statements came a day after demonstrators took over University Yard on the Foggy Bottom campus, five blocks from the White House. About 30 tents remained Friday. Police put metal barricades around the demonstration, not allowing anyone else to join. The university said people who are not students joined the group, and they worked to restrict access.

Student organizers called for more supporters to head to the encampment Friday in the face of threatened disciplinary action.

“Students in the encampment are at risk for becoming houseless, losing all class credits from the semester, and being arrested,” organizers wrote on social media. “We will not falter nor give into to their threats which come from their weak position.”

Selina Al-Shihabi, a 20-year-old Georgetown University sophomore and member of the protest group, said that as of Friday afternoon, there were about 35 demonstrators in the cordoned-off area. She said those who remain have shelter and food, including a donation from a local Palestinian restaurant, that can easily be passed over a very loose barricade. But some students are running low on medication, and the only available bathroom is a bucket that is getting full.

But Al-Shihabi, who is from the Palestinian territories, said those in the encampment were in high spirits despite the fear of possible consequences from authorities.

The demonstration at GWU — organized by the DMV coalition of Students for Justice in Palestine — has remained largely peaceful. Many expressed anger over Israel’s war in Gaza, called for the school to cut ties with Israel and demanded a cease-fire. Some chants called for the state of Israel to be abolished.

Many similar demonstrations at college campuses across the country, such as at Columbia University in New York, have resulted in confrontations with police and ended with arrests. Some student groups expressed anger when Columbia called in the New York Police Department to clear an encampment, while some Republicans are critical that campuses and law enforcement have not moved fast enough.

D.C. police and GWU police kept a low profile as the demonstration grew over the course of the day Thursday, reaching a peak of about 500 at one point. Demonstrators joined from Georgetown University.

The numbers had diminished considerably by Friday morning. Around 100 people remained, chanting, “Free, free Palestine” and “Zionism will fall” as police from GWU and D.C. looked on.

A statue of George Washington at the center of the encampment was draped in a Palestinian flag, and demonstrators handed additional supplies to people behind the barricade.

But they also appeared to be preparing for police action. The student newspaper, the GW Hatchet , wrote that demonstrators had sorted themselves by their willingness to stay despite police. Pink and green groups have left the encampment. Only the red group, those willing to stay until the end, remain.

Inspired by college academic facilities, Holy Trinity Episcopal Academy recently broke ground on their grades 7-12 IDEAS Institute building at their campus just west of Pineda Causeway.

The building, expected to open to students in August 2025, is intended to imitate the "style, feel and dynamics of higher education," according to a press release from the school.

The motivation behind the IDEAS (Innovation, Design, Entrepreneurship and Applied Solution) project is "about promise, about the academic promise of — and to — our students," said Elizabeth Miller, president and head of school at Holy Trinity Episcopal Academy.

"We will continue providing them an educational experience like no other with competitive advantages that prepare them for college. It is the promise of our Board of Trustees to bring a university-inspired building to our community that transcends learning."

Set to be two stories and 30,000 square feet, the IDEAS building will offers students an innovation gym and robotics workshop; a design center; a broadcast/podcast studio; a college and academic advising suite; a presentation/conference space; student commons; 15 classrooms; and in-between spaces and work stations.

Contractors on the project include MELD Studio Architecture, MH Williams Construction Group, MK Structural Engineering, Construction Engineering Group, American Business Interiors, Atlantic Environmental and Pollack Landscape Architects, with JPM Management Company managing the project.
