Common questions about making a Will

What does it take for a will to be valid.

For your Will to be considered legally valid, there are several key conditions that must apply.

The Will must be:

• Made by a person aged 18 or over
• Made voluntarily
• Made by a person of ‘sound mind’
• Signed in the presence of 2 witnesses (who must both be over 18)
• Signed by the two witnesses in your presence

How much does it cost to make a Will in the UK?

The cost of making a Will varies depending on the complexity of the issues involved. For straightforward Wills, we can usually offer a fixed-fee agreed at the outset. However, if there are more complicated issues to consider, we will agree a flexible fee structure allowing you to get all of the support you need while still offering complete transparency over the costs involved at all times.

What happens if you die without a Will?

If you die without leaving a valid Will, your estate will generally be divided according to the standard rules of intestacy. Exactly who inherits will depend on a number of factors, including:

• If you have a surviving spouse or civil partner
• If you have children
• What other relatives you have
• The value of your estate

For example, if you have a surviving spouse or civil partner, they will normally be entitled to the first £250,000 of your estate and all of your personal possessions. They will then be entitled to half of the remainder of your estate, with the other half split between any children you have (or grandchildren if have a child who predeceased you but who had children of their own).

If you do not have a surviving spouse or civil partner, your estate will usually be divided between your children (whose share can pass to their children if one of your children predeceases you).

If you do not have a surviving spouse, civil partner, children or grandchildren, other relatives, such as your parents, brothers and sisters, grandparents or aunts and uncles.

If you have no such relatives, then your entire estate may pass to the Crown.

What happens if you die and you have debt?

Any debts you owe at the time of your death, such as your mortgage or other loans, will need to be paid out of your estate during the probate process . Ensuring these debts are paid will usually be the responsibility of your Executor or Executors.

The debts will normally need to be paid off in a strict order, with secured debts, such as a mortgage coming first, then funeral and estate administration costs and finally unsecured debts, such as a credit card and utility bills.

If there are more debts than can be covered by the value of the estate, this is referred to as an ‘insolvent estate’. In such situations, it is essential to seek legal advice at the earliest opportunity.

Women's Writing Special Issue: Women Writers and Translation

This special issue of  Women’s Writing  seeks to explore the multifaceted realm of women’s translation, spanning from the Middle Ages through the long nineteenth century. Over the past few decades, scholars have produced important insights on the worlds of women’s translation; however, much work remains. In the introduction to the 2023 special edition on translation studies in PMLA , A.E.B. Coldiron argues, “[T]ranslations constitute points of cultural and historical contact too generative to ignore” (419). Coldiron contends the future of literary studies demands scholars acknowledge the significance of translation: “Insisting on more-than-monolingual inquiry will necessarily yield literary criticism at once more precise and more expansive. Literary-cultural specialists who ignore translation, or who treat it instrumentally, do so at their peril, missing the bigger picture” (430). Given this imperative, our special issue seeks contributions that further the discussion of women writers and translation. We invite proposals for essays that engage with translation in a broad sense, including cultural translation, intralingual translation, and transmedia translation.

As Old Boy helmer Park, who also directed the premiere, and McKellar explain in the forward to their script below, the seven-episode The Sympathizer embraces unconventional wisdom and takes a new perspective on a history too many of us have learned from Hollywood movies.

This script is about writing. Writing under pressure, under the scrutiny of merciless supervision. Perhaps some of you can identify. Our hero, the Captain, is an author, a reluctant author, forced to tell his story — or rather, re-tell his story, a story we think we already know — the story of the Vietnam War and its consequences. Our perception of that absurd and horrifying war has been formed mostly by Hollywood, in spectacles that primarily focus on US soldiers and the fallout back home. But the Captain is necessarily telling the story from his side, the other side, a side no less fraught with biases and contradictions, — from the perspective of a Vietnamese communist spy. For ourselves, however, the screenwriters, we don’t mean to suggest that writing this script was torture. It wasn’t. The novel that the series is based on is wildly entertaining, opinionated and frequently hilarious. It was a gift to have the book’s characters and great set pieces in our arsenal. Its sheer verve challenged us to go for some of the bigger swings. It doesn’t turn its nose up at those Hollywood depictions of the war; it tries to get inside them and show why they work. We don’t want to give away the series finale, but suffice it to say that it is his pleasure in storytelling that turns out to be the Captain’s fatal flaw as a doctrinaire communist. He learns that the orthodoxies and agendas fighting to structure and constrict his narrative can’t sustain themselves. In the end, his bare humanity and individuality are all that are left to keep the story going. Ok, we hear you, this may be a self-serving take for a pair of TV screenwriters, but it kept us going through the pandemic and the long road to our air date. Enjoy the read. DM & PCW

Generative artificial intelligence is coming for streaming, with the release of a platform dedicated to AI content that allows users to create episodes with a prompt of just a couple of words.

The endeavor marks the tech industry’s further encroachment onto Hollywood as it eyes the exploitation of AI tools embroiled in controversy over their potential to streamline production and the possibility they were created using copyrighted materials from creators they could eventually displace. Amid the industry’s historic dual strikes last year, in which the use of AI emerged as a contentious negotiating point, Fable released an AI-generated episode of South Park to showcase its tech. While some mocked it for its comedic misses, others pointed to the video as a leap forward in the tech and proof of concept that AI tools will soon allow viewers to more actively engage with content, possibly by creating their own. It also demonstrated the threat the tech poses to creators whose labor could be undermined if it’s adopted into the production pipeline.

“The vision is to be the Netflix of AI,” says chief executive Edward Saatchi. “Maybe you finish all of the episodes of a show you’re watching and you click the button to make another episode. You can say what it should be about or you can let the AI make it itself.”

Users are encouraged to make their own episodes of the shows, the best of which will be included in the catalogue of the series when Showrunner is officially launched. The winners will get a lump-sum payment, as well as revenue sharing if the show is picked up by a streamer. Saatchi says the platform’s tech allows users to create a series of scenes that can then be stitched together to create a full-length episode. Prompts can range from just a couple of words to over 100. Users will be able to edit the dialogue, shots and flow of scenes, among other things, he adds.

“It’ll understand the core conflict of your episode and develop it with another character or location,” Saatchi says. “Or you can say, ‘I want this specifically to be the next scene.'”

Fable, which won an Emmy in 2019 for innovation in interactive media, figures to keep costs down by having users create the content that others will watch. The model demonstrates the anxiety and fear that some creators have over AI: If the tech can function as all-purpose crewmembers and talent, that undercuts the value and demand for their labor. Union protections, some of which bar the use of AI tools for now, will likely take on even more significance if the company can prove there’s a market for completely AI-generated content.

“AI can definitely make better episodes of The Simpsons today,” Saatchi says.

Showrunner is powered by Fable’s AI model, which was created after the release of open-source AI systems from OpenAI and Stable Diffusion. Last year, it released a research paper showcasing tech that it says can write, produce, direct, edit, voice and animate episodes of shows with a large catalogue of content. The company created nine brief AI-generated episodes of South Park from a short prompt.

Saatchi says the system is trained on “publicly available data.” Asked about widespread allegations of the use of copyrighted materials by AI companies to teach their tech, he adds, “What matters to me is whether the output is original” and that the “content is what will decide whether the tech is worthwhile.”

The Writing Center’s writing groups offer weekly time for graduate students to devote to working on their dissertations, theses or other significant graduate-level writing projects in a supportive environment.
