PhD Program

The program will offer pathways for a career in legal research, academia and for enhancing professionalism related to all stake-holders of the judicial system (Civil & Criminal) in Pakistan i.e. officials from courts, judges, lawyers, police, prosecutors, legal consultants, academicians from legal set up/judicial academies. The Research Scholars/candidates of the PhD. Program will complete one year course work, consisting of two semesters. Research Scholars will take four compulsory courses and two Elective courses. Each course has three credit hours and the thesis consists of six credit hours. The total number of credit hours would be 24.

SCHEME OF STUDIES

Part – i (course work), elective courses.

Course work of 18 credit hours preferably in the first year, with minimum 3.0 CGPA, is required to be completed and followed by a comprehensive examination with minimum 3.0 CGPA (in maximum two attempts) for granting candidacy as a Ph.D scholar.

PART – III (Submission Of Research Proposal)

After successful completion of 18 credit hours (preferably in one year), Ph.D. Research Scholars will be required to work on their research proposal under the guidance of their Supervisor(s). They will present their research proposal in a seminar attended by their Supervisor(s), relevant professionals in the field and peers for improvement in research proposal before its submission to BASR.

PART – IV (THESIS)

  • The research proposal will be submitted to BASR and after the approval by the BASR; writing of thesis would be started under the supervision of the approvedsupervisor. It is very important for candidates to note that the degree of Ph.D./LL.D. would be awarded to such research scholar of the DIHE who completes his / her course work and submits his/her thesis which in the opinion of the foreign examiners, contains important and original contributions to the advancement of the study of law, gives proof of his/her academic distinction, and entitles him/her to be regarded as an authority in the field/fields of knowledge in which the work is submitted.
  • The minimum duration within which to submit the thesis is two calendar years after the date of approval of the topic, and the maximum is five years. Seven copies of the thesis would be submitted by the candidate.
  • Modification of topic: A candidate may, within two terms of his/her research proposal approval, modify the topic of research with the approval of the supervisor by submitting an application to the Board of Advanced Study and Research (BASR). In such cases the BASR shall determine the minimum duration after which the thesis may be
  • Appointment of Supervisor: The BASR shall appoint a supervisor of research on recommendation of Dean and Director Post-GraduateOnce a student is enrolled for PhD. he/she shall always have a Supervisor till the submission of thesis with the prescribed maximum period. In case of a Supervisor being not available for 6 months or more, alternative arrangements should be.
  • Progress Reports: The supervisor will submit progress reports of D. student regularly for each semester to Director Post-Graduate Studies.
  • Plagiarism test will be conducted on the Thesis before its submission to BASR for evaluation by the foreign and local experts. A maximum of 19% Similarity Index is allowed in report (not more than 5% from each single source).

Submission of Thesis

  • D. thesis shall be prepared in English language according to APA (6th Edition) format as approved by the University. The thesis of PhD should have abstracts in both English and Urdu language. The students shall be eligible to submit thesis after completing two calendar years from the date of approval of the topic.
  • An unbound manuscript (semi-final-draft) duly checked and signed by the Research Committee including Supervisor, Dean of the Faculty & Director Post Graduate Studies shall be submitted to the BASR for scrutiny and approval before final

It must be noted that the Ph.D Law Program will be governed by the rules and regulations under DIHE Act and further through declarations as made in the BASR (Board of Advanced Studies and Research) and in the Academic Council Sessions from time to time.

University Law College, University of the Punjab, is the finest and oldest seat of legal learning in the country. The University Law College is known as the birth place of the finest legal minds in the subcontinent and has been the epitome of judicial heritage in Pakistan since its inception. A number of eminent bureaucrats, politicians, lawyers and judges of higher and superior judiciary are graduates of the college and continue to serve the country to the best of their abilities. Other than training young legal minds, the college focuses on personality development and grooming of students into responsible citizens.

Law College was established in 1868, fourteen years before the University of the Punjab and has a rich history and culture. It later became one of the constituent Colleges of the University of the Punjab. Law classes were initiated by Anjuman-i-Punjab in 1868 and were taken over by the College in 1870. Initially, the degree was spanned over two years. In 1873 entry test was introduced for admission purposes in the program and in the same year Chief Court allowed the college to hold pleadership Examination. In 1887, passing of intermediate examination was made a prerequisite for admission in the law program. Later that year, three-fourth attendance was made mandatory for appearing in the examination. In 1890, Government of India empowered the college to confer LL.B. and LL.D. degrees. In order to appear in the LL.B. examination, it was necessary for the aspiring candidates to have graduated in Arts and to have passed the intermediate or the Licentiate in the Law examination.

In 1935, College regulations were revised, and the course of instruction for the LL.B. was increased by a year to a span of three years. However, in 1948, regulations were again revised and the course of instruction for the LL.B. degree was reduced once again to two years. In 1964, under the directions of the West Pakistan High Court, the LL.B professional course was extended to three years and in the same year, College started offering two degree courses in Law; B.L. (academic) a degree of two years duration and LL.B. (Legum Baccalaureus) a degree of three years duration. Holders of LL.B. degree were eligible for enrolment as pleaders. In the year 1966 the duration of the LL.B. degree program was converted into two years. However, since 1992-93, three year Bachelor of Law program was re-introduced.

The main building of the College in earlier years were hosted at Katchery Road. In 1978, the college was shifted to the present premises at Quaid-e-Azam Campus. It is worth noting here that Prof. Dr. Shazia N. Qureshi, Principal of Law College, is the first woman principal in the long and rich history of the college. Her appointment is ranked important by both male and female staff members for inculcating values of merit, removal of discrimination against women in the college specifically, and society, generally, it also encourages young women to join the profession.

The University Law College is one of the dynamic and progressive constituent colleges of the University of the Punjab dedicated to the promotion of sound and advanced legal studies in the subcontinent.

Law is body of principles embodying social values, providing one of the principal instruments of change and a frame work for justice through which changes in society, technology and thinking modify. Thus, law plays an invaluable role in bringing out reforms and stimulating in laying down the standards and norm of behavior morality, justice, socio-cultural norms and business practices.

It would be a naive to think that law works in mathematical or mechanical ways.

One may agree with justice Oliver Wendell Holmes that,   “the life of the law has not been logic: it has been experience… The law embodies the story of a nation’s development through centuries, and it cannot be dealt with as if it contained only the axioms and corollaries of a book of mathematics”.

It is pertinent to mention that a large number of alumni, are the prominent member of bar as well as are holding eminent positions in higher judiciary in legal departments of government as well as in multinational law firms throughout the world.

University administration, particularly venerable vice chancellor, is highly interested to strengthen the level of advance legal education and research in the law college.

My best wishes to the students graduating today and the new comers, for you, a new and bright career is awaiting. The field of law is wide open and it has reached new horizons. If you are fully equipped, talented and prepared to work hard, I am sure, every one of you would shine like a bright star. As a small department back then, it allowed us as law students to mingle with students of other faculties. We had the faculty that started the program and were very invested in us.

How do you think your time at SAHSOL prepare you for your professional career?

It prepared me in many ways, for research and writing and also for practice.

We were taught by extremely dedicated and learned professors who became our mentors and shared with us both knowledge and inspiration. Many of the class-mates turned into the best of friends and we made life-long connections.

How do you think your time at SAHSOL prepared you for your career?

The variety of subjects taught during the degree enabled me to broaden my intellectual prespective work well under pressure and build strong foundations in many areas of law.

What is the best career advice you have ever gotten?

Whilst there is no piece of advice that could be universally applicable, for me the most important career advice is that one must work hard and be fully dedicated to the work that they are doing.

Umair has recently been promoted as the Registrar at the Competition Commission of Pakistan, where he assists the Commission in its adjudicatory functions and heads the legal department.

Prior to this, Umair was on deputation to the Ministry of Federal Education where as Joint Secretary and Director General Education, he lead on the Federal Government's Ed-tech & STEM initiatives, the national COVID-19 education response and public education service delivery in Islamabad.

He also co-lead on the Teleschool project that received recognition from the Prime Minsiter of Pakistan.

The Constitution of Pakistan: A contextual Analysis

This volume provides a contextual account of Pakistan's constitutional laws and history. It aims to describe the formal structure of government in reference to origins that are traced to the administrative centralisation and legal innovations of colonial rule. It also situates the tide of Muslim nationalism that gave rise to the nation of Pakistan within a terrain of nascent constitutionalism and its associated promises of representation. The post-colonial history of the Pakistani state is charted by reference to succeeding constitutions and the distribution of powers between the major branches of government that they augured. Where conventional histories often suggest that constitutionalism in Pakistan is to be solely understood by reference to a cycle of abidance and rupture, and in the oscillation between military and civilian rule, this volume also accounts for the many points of continuity between regime types. The contours of a broader constitutionalism come to light in the ways in which state power is wielded at different periods and in the range of contests - economic, political and cultural - through which some of this power is sought to be dispersed. Chapters on Rights, Federalism and Islam detail the contextual features of some of these contests and the normative, legal parameters through which they are provisionally settled.

Criminal Punishment and Human Rights: Convenient Morality

This book examines the relationship between international human rights discourse and the justifi cations for criminal punishment. Using interdisciplinary discourse analysis, it exposes certain paradoxes that underpin the ‘International Bill of Human Rights’, academic commentaries on human rights law, and the global human rights monitoring regime in relation to the aims of punishment in domestic penal systems. It argues that human rights discourse, owing to its theoretical kinship with Kantian philosophy, embodies a paradoxical commitment to human dignity on the one hand, and retributive punishment on the other. Further, it sustains the split between criminal justice and social justice, which results in a sociologically ill-informed understanding of punishment. Human rights discourse plays a paradoxical role vis-à-vis the punitive power of the state as it seeks to counter criminalisation in some areas and backs the introduction of new criminal offences – and longer prison sentences – in others. The underlying priorities, it is argued, have been shaped by a number of historical circumstances. Drawing on archival material, the study demonstrates that the international penal discourse produced during the late nineteenth and early twentieth century laid greater emphasis on offender rehabilitation and was more attentive to the social context of crime than is the case with the modern human rights discourse.

SAHSOL proudly shares the victory of our mooting team comprising of Ms. Aleezay Saeed (President Law and Politics Society, Class of 2024), Ms. Laiba Amjad Lone (Class of 2024) and Mr Syed Qasim Abbas (Vice President Law and Politics Society, Class of 2024). They were declared the best team at the national round of the 14th Henry Dunant Moot Court Competition, 2022, sponsored by the International Committee of the Red Cross (ICRC). In addition, Mr Syed Qasim Abbas has also been awarded the best Advocate/Speaker at the competition.

We look forward to seeing the team compete successfully at the regional rounds by the end of this year.

We are proud to share that our student Ms Maryam Asad (SAHSOL BA/LLB Class of 2023) will be representing LUMS as a Cultural Ambassador of Pakistan in U.S Department of State in their Global Undergraduate Program for Spring 2023. It is a U.S state funded and highly competitive program. She is among the top 50 to share Pakistan's culture with the Americans. For the ongoing Fall 2022 semester, she is currently studying History at Xavier University, New Orleans, Lousiana as an exchange student.

Congratulations to Ms. Wardah Noor, Founder of KhudKaar!

We are immensely proud of our student, Ms. Wardah Noor (SAHSOL BA/LLB Class of 2023) who has been awarded the Youth Excellence Award by the Prime Minister of Pakistan. Ms. Noor is the founder of KhudKaar, an organization dedicated to capacity building and poverty alleviation in Layyah. KhudKaar has also recently been awarded a $10,000 grant from Global Fund for Children. They are one of the few winners from South Asia.

Let's welcome our second cohort of Legal Writing Lab, a student led initiative managed by fourth and fifth year law students who have received extensive training on legal writing by our faculty members. All three students will team up with Marha Fathma (class of 2023) and Syeda Areeba Hussain (class of 2022) to provide tailored advice to students for strengthening their analytical, critical, and persuasive writing skills. Student members of the Lab conducts one on one sessions and online consultations. In addition, the Lab plans to offer collaborative workshops with faculty members in this summer. Stay tuned.

A special congrats goes out to our first year BA-LLB student Syed Qasim Abbas who co-authored and published an article titled "U.S. Freedom of Navigation Operations and Pakistan-Legality under International Law and Geopolitical Implications" for the Research Society of International Law (RSIL), a Pakistan-based policy and research institution. His article assesses the credibility of navigation operations conducted by the United States in territorial waters under the United Nations Convention on Law of Seas from the perspective of South Asian states, namely Pakistan, China, and India.

Additionally, Qasim’s opinion piece on Craig Jones’ book " The War Lawyers: The United States, Israel, and the Juridical Warfare " was also a part RSIL’s publication.

We are proud to share that our recent graduate Fatima Wahab Khan (Class of 2022) has founded the Legal Aid Bureau in collaboration with Adal Aur Sehat, a Karachi-based NGO to offer pro-bono services to victims of domestic violence and abuse. The aim is to provide free legal aid to women belonging from destitute communities and underprivileged socio-economic class. To date, the bureau has been successful in securing protection orders for three clients.

Higher education commission HEC of Pakistan has provided certain eligibility criteria for PhD admissions at these Universities. Criteria for admissions

  • Applicants must have passed Intermediate/ A levels or equivalent and Law Admission Test (LAT) with a minimum of 50% score. Candidates waiting for results may also apply.
  • Max. age 24 (No max age limit for disabled/special persons)
  • In addition, candidates will have to submit a personal statement and appear in interview before admissions committee.
  • We have limited number of seats. Applications will be considered on first come, first served basis.

Admission to PhD programme in the National Institute of Pakistan Studies (NIPS) is only made on competitive basis. This is purely in accordance with the rules and directions of the Higher Education Commission (HEC) of Pakistan and the quality assurances measures at the Institute. The minimum period for completion of PhD programme is three years whereas the maximum period is seven years. Only under exceptional circumstances and conditions, to be described in detail by the candidate and supported by the supervisor’s recommendation, the research board may allow extension beyond seven years.

Terms and Conditions/Eligibility Criteria

A candidate aspiring for admission into PhD at the Institute must:

  • Possess an MPhil degree or its equivalent with a minimum CGPA of 3.00 or first division in social sciences from a recognized university.
  • Submit a copy of his/her tentative research project. Admission will be given subject to the availability of the supervisor in the relevant field of research and strictly according to HEC’s rules and requirements.
  • For college/university teachers and all in-service candidates, a No Objection Certificate (NOC) from the employer is mandatory to be attached with admission form and moved through proper channel.

Special Note: The Institute is bound to follow future rules and regulation or any other requirements, with regard to admission into PhD program, as indicated by the Higher Education Commission (HEC), Quaid-i-Azam University, or any other regulatory body.

Admissions are opened in a Ph.D. degree program for the session of 2024 all over Pakistan. Interested candidates can get admission to their desired university, college, and institutes. All those universities and colleges are allowed to offer admission who are registered from Higher Education Commission.

PhD Merit Criteria 2024

There are merit criteria for selection in the Ph.D. program. Candidates must have 18 years of education in their selected field. Students have 3CGPA out of 4 CGPA or a minimum of 60% marks in the annual system in M.Phil/M.S/Equivalent degree. Most universities requiring the entry test pass by the subject test of NTS or ETS, ETEA, MDCAT, ECAT, and others.
