The controversial Department of Education (DepED) Order No. 49 s. 2022 has two goals: To depoliticize the department and promote professionalism among its personnel.

After gaining complaints from educators and the public alike, DepED Spokesperson Michael Poa, in a televised interview, clarified the goal of the department’s issuance of DO No. 49.

According to Poa, DO 49 is just a mere “reminder” to observe the “existing rules” as civil servants. Under the issuance, DepED personnel were mandated to treat colleagues and learners with the “highest degree of professionalism.”

“There’s no specific trigger in the issuance of the order. In fact, the DO refers to the Code of Conduct and Ethical Standards or what we call Republic Act 6713. We’re just issuing this order to remind DepED personnel in terms of professionalism and depoliticization ,” said Poa in an interview over CNN Philippines on Tuesday, Nov. 15.

Requests in most Philippine government agencies, according to Poa, are now being politicized and this specific scenario is what DepED is “avoiding” to happen.

Apart from serving their duties in “prompt,” “courteous,” and “fair” manner, educators were likewise told to “avoid relationships, interaction, and communication including following social media with learners” outside school setting.

“As civil servants, we have to be responsible social media,” said Poa, adding that teachers may still communicate with learners through social media “as long as it is within the school setting,” or is limited within the “student-teacher” relationship.

“We are just reminding them of their duty to also be professional teachers,” Poa added.

Earlier, the Alliance of Concerned Teachers (ACT) Philippines slammed this order, calling it “ironic” and “questionable,” since DepED greenlighted the use of social media platforms during the implementation of full distance learning amid the Covid-19 health crisis.

Poa, on the other hand, stressed that DepED is only “reminding” teachers not to “cross the line” or have “biases.”

LET US be clear at the outset: Vice President Sara Duterte is not the Department of Education. In the same manner, the teachers are not the  Department of Education; neither are the political parties, nor the random FB post — not even this columnist.

For here’s the thing: for a democratic society to function for the common good — taking into consideration our varied social roles and personal interests — there has to be an ideal standard, a universal precept, that we must all be accountable for as public officials, as employees, as citizens. In this particular case, as teachers.

What is this universal precept?

It is an expectation (more of a Kantian Categorical Imperative) that the Department of Education has set for everyone to fulfill regardless of rank, situation, opinion, or unfair treatment.

We are expected to act with Professionalism: by practicing what we preach, by following a code of conduct (in this case R.A. 6713, otherwise known as the Code of Conduct and Ethical Standards for Public Officials and Employees) as the ideal and non-negotiable condition that teachers must take into consideration for all intents and purposes.

And this is where the problem lies: We, the teachers, are sometimes guilty of corruption—in our own small actions and conspiratorial practices. Biases abound from a simple class activity to a bureaucratic “educational” transaction. Grudges color our intentions and interactions—from expressing with destructive criticisms to “cooperating” with a crab mentality. Pride and ego would sometimes dominate the classroom setting and thus tempt teachers to behave in harmful ways.

With over 900,000 teaching personnel and at least 60,000 schools nationwide, how do you protect the more than 27.1M students from school-related abuses?

Vice President Sara Duterte said that this (DO No. 49) is meant to minimize biases that teachers wittingly or unwittingly do (for the bias had become a culture) as well as prevent criminal incidents from occurring. Rightly so.

It is the duty of the State to protect its citizens. It is the role of the teachers to provide “parental” guidance to students (for the school is the second home). And to ensure that the classroom is conducive for learning and the students are safe to learn, this DepEd ORDER No. 049, s. 2022, for all intents and purposes, has been issued for the common good.

But there is an opposing view (as expected).

Rep. France Castro (ACT Teachers party-list) questioned the intention of the order:

“Why does the Department of Education feel the need to create such an order that gags and threatens teachers and education support personnel which treats them as mere creatures only of the school and dehumanizes them preventing them to exercise their right to free speech, expression, to organize and be able to voice out their grievances?”  

The intention of the order changed from Professionalism to Dehumanization. And by the way, Freedom of Expression is a fundamental human right (Article 19 of the Universal Declaration of Human Rights) as well as a Constitutional Right (Article III, Section 4, Bill of Rights of the 1987 Philippine Constitution). With this, then, a Department Order can NEVER violate or take that right away (pun intended).

Further, Rep. Castro said:

“If the education department insists on gagging its employees online and offline and prevents them from relating to others on things, not about the school, what else is left of them?” 

The said criticisms refer, among others, to the following sections:

1. (e) Raise issues and concerns regarding basic education via formal and appropriate DepEd channels , either directly to the Office of the Secretary or through the concerned Assistant Secretary or Undersecretary, without resorting to any political or third-party intervention or accommodation  (emphasis mine);

2. (e) Avoid relationships, interaction, and communication, including following social media with learners outside of the school setting ,  except if they are relatives (emphasis mine); and

3. (c) Shall not disparage DepEd and must always be mindful of the reputation and honor  of the organization (emphasis mine).

To answer the question “what else is left of them?”, then that would be Professionalism: that there is a line between personal preference and professional interactions.

I personally believe that teachers cannot use social media the way their students do. For our actions will always be associated with our chosen profession, whether we like it or not.

I am not trying to cover up the flaws of the Department of Education. I am here to expose our own hypocrisy. For I always believe that personal responsibility and accountability come first, then individual rights second.

A credo to remind me:

To be grateful to DepEd for testing my resolve to still choose to be a teacher even if the ideals are swallowed by the practicalities. Because this is all about learning. And learning is an ongoing process. For teachers, it is professionalism every step — and mistake — along the way.

“If the ship is sinking, I will find a way to save the people. I don’t have the time to blame the captain and begrudgingly wear the lifejacket—and keep swimming.”  

I will teach those students. I will read those books. I will correct my mistakes. I will not give up. And this, in itself, is what I want my students to understand: That in any profession, it won’t be fun and smooth sailing all the way. There will be chaos, betrayals, downright hypocrisy, and immorality: a perfect storm. Now what will you do? Your very life is your contribution to the problem or the solution.

Akala natin, magtuturo lang. Eh, hindi naman ganyan sa totoong buhay: na andiyan na lahat at walang kulang o kulelat. Kahit nga sa pag-iibigan nagkakasakitan. Gusto ko lang naman ituon ang ating pansin sa realidad na ang pagtuturo ay hindi para lang na gawing “matalino” ang mga estudyante. Sa kabilang banda, sila ay nasa paaralan para matutunan nila kung paano mabigyan solusyon ang mga problem sa buhay pag sila ay “nakapagtapos na sa pag-aaral.”

IN CLOSING, DepEd ORDER No. 049, s. 2022 is a commendable move by the DepEd. Unless the opposing side presents a better alternative instead of just having a “political tantrum,” then this policy is worthy of consideration for its overall message: that we are all professionals. And as professionals, there is a certain ideal we need to follow for being part of the system; as professionals, the impunity of others is not a justification for us to behave in the same way.

TACLOBAN CITY — The spokesperson of the Department of Education (DepEd) hsa clarified that teachers are not prohibited from using social media amid the controversy sparked with the issuance of Department Order No. 49.

DepEd spokesman Atty. Michael Poa said the order, among others, merely asked the teachers to “avoid following” their students and uphold professionalism.

“We are not ordering teachers not to use social media. What we are saying is there should be a line between teachers and the learners. Once teachers cross that line, it might create a lot of problems,” said Poa was in Tacloban on Wednesday (Nov. 9) to attend an executive meeting among officials of the DepEd in the region.

Under Department Order No. 49, DepEd personnel have to “avoid relationships, interaction, communication, including following social media with learners outside of the school setting, except if they are relatives.”

Vice President Sara Duterte, who is also education secretary, explained the order was intended to minimize biases on the part of teachers and prevent “criminal” incidents from happening.

Poa said past sexual abuses involved teachers and students used private messages as evidence.

And this is what the order wants to avoid, Poa said.

“Department Order 49 was not meant to sow fear. We want to maintain professionalism among our teachers,” he said.

Poa said teachers and their students could still be “friends” on social media and create group chats but must strictly discuss school-related matters.

Meanwhile, Poa admitted there were learning gaps affecting students as a result of the modular modality applied because of the COVID-19 pandemic.

And these learning gaps are being addressed by the DepEd starting off with the full in-person classes.

“That is why we need to start learning recovery. Each region was asked to contextualize their learning recovery plans so it could be implemented in the field. We need to start that and the good way to start that is we need to bring our learners back to school,” Poa said.

While the process may take some time, he said the DepEd is determined to breach or narrow the gaps.

FACTS: This case involves the constitutionality of the old probation law. Respondent Cu Unjieng was convicted by the trial court in Manila. He filed for reconsideration which was elevated to the SC and the SC remanded the appeal to the lower court for a new trial. While awaiting new trial, he appealed for probation under the provisions of Act No. 4221. Judge Tuason of the Manila CFI directed the appeal to the Insular Probation Office. The IPO denied the application. However, Judge Vera upon another request by petitioner allowed the petition to be set for hearing. The City Prosecutor countered alleging that Vera has no power to place Cu Unjieng under probation because it is in violation of Sec. 11 Act No. 4221, which grants provincial boards the power to provide a system of probation to convicted person. Nowhere in the law is stated that it is applicable to a cities like Manila as it is only indicated therein that only provinces are covered. And even if Manila is covered by the law, it is unconstitutional because it is violative of the equal protection clause of the constitution. It also avers that the said law provides absolute discretion to provincial boards, thus it constitutes undue delegation of power. ISSUE: Whether or not Act 4221 or the old probation law is an undue delegation of legislative power on the ground that there is no standard set by congress for its implementation. HELD: Yes. There is undue delegation of power because there is no standard provided by Congress on how provincial boards must act in carrying out a system of probation. The provincial boards are given absolute discretion which is violative of the constitution and the doctrine of the non delegability of power. Further, it is a violation of equity so protected by the constitution. The challenged section of Act No. 4221 in section 11 which reads as follows: This Act shall apply only in those provinces in which the respective provincial boards have provided for the salary of a probation officer at rates not lower than those now provided for provincial fiscals. Said probation officer shall be appointed by the Secretary of Justice and shall be subject to the direction of the Probation Office. This only means that only provinces that can provide appropriation for a probation officer may have a system of probation within their locality. This would mean to say that convicts in provinces where no probation officer is instituted may not avail of their right to probation. ARANETA VS. School teachers don’t have to be friends on social media with their students unless the tutor and pupil are already relatives, the Department of Education ordered recently.

Through Department Order No. 49 series of 2022 released on Wednesday, DepEd told its officials and employees to exercise caution in using Facebook and other online platforms and refrain from “following social media with learners” unless they are family members or are related.

The order was issued to promote professionalism in the delivery of basic education programs and services. It stressed the provisions of the current Code of Conduct and Ethical Standards for Public Officialsand Employees and reminded department workers to always adhere to “acceptable norms of conduct and relations in DepEd.”

This includes avoiding “relationships, interaction, and communication, including following social media with learners outside of school setting,” the order dated Nov. 2 emphasized.

In explaining the order, Vice President and Education Secretary Sara Duterte-Carpio said the friendship between teachers and students should stay within a school setting and not extend outside the campus.

Both teaching and non-teaching personnel of the DepEd must relearn and emphasize what she called “professionalism,” the VP added.

“As a teacher, there should be a line between him or her and the learner. They should not have friendly relations with their learners outside of the learning institution setting because a bias will be created for a person who is friends with someone. Of course, relationships have their own problems,” Duterte-Carpio said.

The new order amends DepEd Order No. 47, or the Promotion of Professionalism in the Implementation and Delivery of Basic Education Programs and Services.

Meanwhile, amid its five-day in-person classes mandate for all public schools nationwide, the DepEd has allowed public schools with “exceptional circumstances” to proceed with blended learning.

Under DepEd Order No. 50 series of 2022, dated Nov. 3 and signed by Duterte-Carpio, public schools that are unable to comply with the mandated five-day in-person classes “due to exceptional circumstances” must submit their request for continuation of blended learning beyond Nov. 2.

DepEd earlier said at least 261 schools sustained damage from Tropical Storm Paeng.

“Nonetheless, schools can continue to implement the blended learning modality during the pendency of the request,” the order read.

“The approving authority for the implementation of blended learning modality in select public elementary and secondary schools beyond Nov. 2, 2O22 shall be the schools division superintendent (SDS), whose decision shall be subject to review by the regional director (RD),” it added.

Circumstances to allow blended learning to continue include the delay in the construction of school facilities, immediate need for relocation of the school, shortage of basic education resources, “unfavorable” peace and order situation, and use of classrooms as temporary evacuation centers.

The Education chief cited recent “incidents” when DepEd personnel were involved in criminal activities or became victims of crime.

“Some teachers go out with their students, and they’re involved in, should we say, criminal, not really criminal activities, but they are involved in crime. It’s either they become suspects or victims,” she explained.

“In one case, we had a teacher having a drinking spree with a student, who stabbed him. So, these are instances that are preventable if our teaching and non-teaching staff recognize there should be a line not crossed.”

On a sexual harassment case in Cavite, Duterte said a preventive suspension was imposed on teachers involved, while students were assisted in the legal process.

DepEd officials and employees are also told to refrain from engaging in any relationship or activity that may affect their ability to “make objective decisions” in their performance of duty.

They should also respect the rights of others and avoid any activity that is not in accordance with the “law, good morals, good customs, public policy, public order, public safety, and public interest.”

The department said it expects all personnel to always treat and approach their colleagues, employees, and learners with the “highest degree of professionalism, skills, and excellence.”

The new order also states that Education employees and officials should always consider the legal implications of what they post on social media and should not take part in spreading rumors or false information.

Additionally, they shall not make online attacks against their fellow employees, nor “disparage” DepEd, and must always consider the reputation and honor of the education department.

The order said that official DepEd email addresses should only be used for work-related engagements and never for personal social media accounts, profiles, and other activities.

The new DO also underscores the reminder to never engage in partisan activities, including “seeking endorsements, recommendations, contributions, support, consideration, political accommodation, or any intervention from other government personnel or similar entities outside DepEd.”

DepEd also prohibits “soliciting favorable actions from politicians” and “requesting or obtaining support or endorsement from any third party in the hiring, transfer, promotion, removal or any other personnel movement.”

In raising issues or concerns regarding basic education, DepEd told employees and officials that these should be directed to the formal and appropriate DepEd channels, including the Office of the Secretary, or through the concerned Assistant Secretary and Undersecretary, without resorting to invention from any third party.
