Research paper on "Medical Negligence - Law and Practice in Bangladesh"

Medical negligence is a clear violation of the right to health by a professional group who are actually on duty to protect when emergency strikes and the health rights are under threat. Medical negligence is lately a popular topic of attention and discussion in many developed states and consequently, many of them have enacted and established separate Acts and courts to strengthen health care laws. However, in Bangladesh, there is no specific and comprehensive legislation to prevent medical negligence though many legal provisions are there under different statutes which are not precisely codified. It is essential for all clinicians to understand the elements of medical negligence, reasons why patients sue doctors and the process of medical litigation. The medical expert witness who articulates the standard of care both in the report and under cross-examination needs to be skilled and acquire proficiency. Acquiring the skills and strategies required for each stage of the litigation process is, therefore, essential for all medical professionals. Such a skilled and knowledgeable medical professional would not succumb to the negative impacts of defensive medicine and the litigation stress syndrome. This article in this background has made an effort to define medical negligence, present laws concerning medical negligence of Bangladesh with their major loopholes and lastly recommends some actions to come on strong preventing such violation of health-care rights.

Medical negligence is an issue of serious human rights concern that directly affects right to life and right to health care. The term medical negligence generally refers to the negligent or rash act of medical professionals in violation of the duty of care they owe to their patient. In a broader sense of the term, or when medical negligence is referred to as an issue, it also includes other kinds of professional misconduct causing sufferings of the patients. Medical negligence, both in public and private health care sectors of Bangladesh, is a major human rights concern. The overwhelming number of incidents of medical negligence mostly goes without any legal action, leading to a frustrating situation where public trust is completely lost on the medical service providers. Although the legal remedies available under the existing laws are limited or difficult to access, such efforts give a clear idea about the shortcoming of the existing law and the underlying difficulties in the judicial system. This study is endeavored to focus on the medical negligence and fraudulent practice in the hospitals and clinics and to ascertain the legal status in the context of Bangladesh with the recommendations for dealing with the issue.

Criminal prosecution of doctors due to medical malpractice has created controversy in Indonesia. The purpose of the research is to find out the impact of criminal prosecution of doctors in Indonesia, particularly those due to medical malpractice cases. The data were collected through both library-based study and field study in the form of interviews. It is found that criminal prosecution of doctors in the context of medical malpractice has brought about negative consequences such as the exploitation of doctors by law enforcement officers and the practice of defensive medicine. It is found that criminal prosecution of doctors due to medical malpractice should be limited in order to promote justice in the medical malpractice issue. The article concludes with some elaboration on the necessary reforms required in regard to the law relating to medical malpractice in Indonesia.

Meteorology is one of the factors that plays an important role in assessing the quality of the atmospheric environment. Regarding the air pollution, especially dust and gaseous emissions, there are currently few studies on the relationship between meteorological factors and the increase in pollutant concentration. In this study, the relationship between several meteorological parameters such as temperature (TEM), wind speed (WS), wind direction (WD) and PM10 content in Hanoi were evaluated through the Spearman correlation coefficient (r) by SPSS statistical analysis software. Data includes hourly meteorological factors (temperature, wind speed and wind direction) and 24-h PM10 concentration collected at three automatic air quality monitoring stations in Hanoi in 2018. Kirromycin is the main product of the soil-dwelling Streptomyces collinus Tü 365. The elucidation of the biosynthetic pathway revealed that the antibiotic is synthesised via a unique combination of trans-/cis-AT type I polyketide synthases and non-ribosomal peptide synthetases (PKS I/NRPS). This was the first example of an assembly line integrating the three biosynthetic principles in one pathway. However, information about other enzymes involved in kirromycin biosynthesis remained scarce. In this study, genes encoding tailoring enzymes KirM, KirHVI, KirOI, and KirOII, and the putative crotonyl-CoA reductase/carboxylase KirN were deleted, complemented, and the emerged products analysed by HPLC-HRMS and MS/MS. Derivatives were identified in mutants ΔkirM, ΔkirHVI, ΔkirOI, and ΔkirOII. The products of ΔkirOI, ΔkirOII, and kirHVI were subjected to 2D-NMR for structure elucidation.
