The J&K High Court’s verdict on the Beggary Act rejects the state’s fettering of guaranteed constitutional freedoms

Since independence Government of India is playing an important role to render justice to its people in every aspect of life.
But due to disproportionate distribution of wealth, poverty situation is caused.
The poverty coupled with disadvantaged condition of life forced many to live like beggar in the society.
Beggary is an age old social phenomenon in India. This system of begging and alms-giving to mendicants and the poor is still widely practiced in India.
India has huge number of beggars and West Bengal has top the list of beggars among the states.

Meaning and Concept

Beggary is defined as soliciting or receiving alms in a public places, whether or not under any pretence such as singing, dancing fortune telling, performing or offering any article for sale, entering on any private premises for the purpose of soliciting or receiving alms, exposing or exhibiting with the object of obtaining or extorting alms, any sore, wound, injury, deformity or disease whether of a human being or animal, or having no visible means of subsistence.
Beggars may be found in public places such as transport routes, urban parks, and markets.
Beggars have existed in society since the inception of human civilization.
Begging is witnessed in all most all societies around the world.

Constitutional parameters

The Indian constitution guarantees every citizen, the right to earn livelihood and the protection of social and economic rights.
A right is claim of an individual integral to realize human rights and ensure individual freedom and dignity.
Poverty is one of the most critical Conditions of life which touches human rights issue.
Being a social welfare state, the constitution of India guarantees to all persons, without any distinction of status, the right to life and personal liberty.
The Supreme Court of India has broadly interpreted Article 21 of the constitution and held that right to life mean right to life with human dignity, free from all exploitative condition.
Court has made it clear that, the expression right to life in Article 21 includes Right to livelihood.

Article 23(1) is to be read with articles 39(e) and 39(f) which impose obligation on the state for protection of persons against exploitation and against moral and material abandonment.

Ram Lakhan v State (Case dealing with anti-Begging law)

The Delhi High Court moved away from the judicial practice of castigating begging and upheld its legitimacy through a comparative discourse on the common law doctrines of necessity and duress, as well as on the principles of equality and liberty embodied in the Constitution.
One significant aspect of Ram Lakhan is that it addresses the issue of begging from the touchstone of Article 19(1)(a), read with Article 21 of the Constitution, and asserts that unreasonable prohibitions on begging are unconstitutional in that they invariably deprive beggars of two fundamental rights.

The Criminal Law (Amendment) Act, 2013 provides for an imprisonment for a convict of beggary (10 years). The Act prescribes following provision:

Beggars may be arrested without warrant.
They can be sentenced to jail without trial or may be sent to shelter homes/certified institutions.
The punishment for beggary ranges from 3-10 years imprisonment.
Court may pass detention of persons if totally dependent on beggar.
Prescribes Penalty for employing persons to beg or using them for purposes of begging.
Provisions are made for the teaching of agricultural, industrial and general education.
Provisions are made for medical care of the inmates of the Receiving Centres and/Certified institutions.
If any beggar detained in a certified institution, found to be of unsound mind or a leper, he/ she can be removed to a mental hospital or leper asylum as per provisions of the Indian Lunacy Act, 1912 and of the Lepers Act, 1898.

Beggary is a social problem and this has been accepted way of life. The government intend to abolish beggaries from the society. The states have taken a lot of measures to abate poverty. The move is good, but while implemented in the social milieu it causes harassment to the innocent people. It is perceived that, the rehabilitation strategy is not matching with the legal parameters. The attitude of the personnel of beggar home need be changed. The rehabilitation institution should not be treated as jail. It should have capacity to change the mind-set of the inmates those can find an alternative for sustenance.

Unfortunately, most beggars are children.

Children have the ability to invoke sympathy from people. Thus, families often send children to beg and fend for the entire family. Another category of children who beg is part of child trafficking rackets. In some cases, families are forced into begging when an unfortunate event like the death of the bread earner or loss of assets due to natural disasters occur. Beggars often live in slums or on the roadside or below a bridge.

They do not have access to basic living conditions like clean water or sanitation. They cannot afford education for their children or the cost of a hospital when they fall sick. Beggars are found everywhere. More commonly, they can be seen in traffic signals or outside temples, mosques, or churches. These religious places are particularly targeted as this is where people are more likely to donate for charity.

When children beg instead of going to school, the nation loses out on the opportunity of not only another bright mind, but it is also a drawback for the literacy efforts. Lack of employment is the major cause of begging. As much as many people consider beggars to be a burden on the country, we must understand that ignoring the problem will not solve it. It is our responsibility to explore the causes and find a solution to the problem plaguing our society today.

Factors which lead to Begging in India

Poverty is by far the major cause noticed across the country. As per data by the Ministry of Social Justice, there are about 4 lakh beggars in the country. The highest number of beggars are found in the state of West Bengal. This means that more than 4 lakh people do not have a fixed source of income and are vulnerable to exploitation. They do not have access to education, water, food, or even a roof over their head.

Unemployment is another significant cause leading to begging. There is huge competition for unorganized sector jobs in the country. The demand is lesser than the supply. With no education, manual labour and other unorganized sector jobs are the only options for beggars. Contractors use this compulsion to their advantage and pay very less, especially to children and women. This leads to not being able to earn enough to feed the entire family.

Thus, they are forced to beg for help. Further, unskilled labour opportunities are few and far apart. The government has failed in providing them with productive opportunities. Vices are yet another cause of concern. Often, families do earn enough for sustenance if the earnings are appropriately managed. But, when they indulge the money in gambling, drinking, and other vices, they fail to take care of their family. These not only forces children to drop out of schools, but it also leads to young hands begging for food.

Eradicating Begging

The union government has developed a centrally sponsored Integrated Child Protection Scheme (ICPS) for children in need of care and protection (CNCP), including those caught begging. Implementation of parts JJ Act or the Juvenile Justice Act, which can help in eradicating begging, has been implemented in various states. But the Delhi HC declared in 2018 that begging is not a crime. However, no particular efforts have been taken by the government to target and eradicate begging particularly.

This is the reason why the government came under fire for shifting beggars when US President Donald Trump visited India. It is necessary that we, as a society, support the government in the eradication of begging as a practice. Instead of attacking the problem from its roots, we are presently trying to find temporary solutions. We must find ways to prevent children from begging to begin effectively. This has a major impact on the development of the child. As citizens, we must not encourage children who are begging by giving money.

Further, any such cases of begging should be reported to the government as it is not only child abuse but also child labour. Further, the government must implement mechanisms to provide unskilled employment to able-bodied beggars. This will not only provide them with an income, but it will also help them contribute to the nation’s productive activities. Those with vices must be rehabilitated if required. Further, abandoning old aged parents must be made a crime. Old age homes must be arranged for them.

Overview of the Beggar Problem in India

At present, in India there are over 4 lakh beggars (Census 2011); most of them can be found on streets, railway platforms, tourist spots, and religious places, among others. These individuals subsist on the bare minimum, without a roof over their heads or a daily source of food, and go through an undignified life. Such conditions of living, as per Article 21 of the Indian Constitution, violate their most basic fundamental right, that is their right to life, which entails not only survival but being able to live a complete life of dignity and meaning.

Yet most beggars are almost always treated and viewed poorly by the public and government officers alike. This raises the question of what the ground reality of the beggar problem in India looks like? Whether the government of India has taken cognizance of this issue or not? And what can we as individuals do to address this issue?

Begging is a widespread problem in India, and it affects a wide section of individuals like children, women, old people, transgenders, and people with disabilities who are prone to exploitation, sexual abuse, and human trafficking.

Despite numerous schemes, programmes and policy changes the ground reality remains and often these group of individuals are rendered helpless due to their socio-economic state and lack of welfare intervention from the state.

Ever since the pandemic the Indian government has taken up the issue of beggars with great concern. Yet, the apathetic outlook that beggars face continues to put them at a disadvantage, and unless they are empowered by the State under various constitutional provisions through proper enforcement and monitoring of schemes and policies, they along with the development of the country will continue to suffer.

Beggars face multi-dimensional problems and hence to understand the root causes of these issues we must look at it through different perspectives.

Economic perspectives on begging in India

India has a large population of people living below the poverty line, which means that many people struggle to meet their basic needs, such as food, shelter, and healthcare. The rising levels of inflation and unemployment post-pandemic has further exacerbated the problem and has forced many people to resort to begging as a means of survival.

Begging in India can be attributed to various economic factors. Some key economic factors among them are the unavailability of economic opportunities due to poverty, lack of access to education or skills, lack of social safety nets and social exclusion from mainstream society.

Additionally, the issue of lack of access to education and employment opportunities can fuel the poverty-cycle, thus create inter-generational dependence on begging as a means of survival.

Social perspectives on begging in India

Begging is too deep-rooted in Indian society, and the main causes must first be addressed. From a social perspective, most parts of begging are unfortunately sanctioned by religion in India in the name of noble acts. People at worship places unknowingly incentivise acts of begging by providing beggars with alms. It must be made clear here that while such acts have good intentions behind, they mostly have a negative impact as these beggars gather at such places and make the act of mendicancy their mode of living.

Another major issue is regarding the public perception both that of “concern” and “neglect”. The public perception of “concern” towards these individuals leads us to donate alms or money whenever we see them by the roadsides, however, studies and investigations by research centres and NGOs have found that in most parts across India, beggars are associated with begging cartels. Wherein each group has its own leader and functions within its own territory. They force young women, children and sometimes even drug babies to gain sympathy from the public to receive alms. And at the day end, these group leaders share the earned money from them among themselves.

On the other hand, these beggars that we neglect and walk past, often fall prey to human traffickers who sell them to prostitution brothels or force them into labour in factories. Thus, there is a serious need to raise alertness and awareness among the public regarding these vulnerable sections and work with civil societies to provide them better livelihoods, care, access to essential services and economic opportunities through capacity building programs and schemes.

Legal and policy frameworks

The subject of begging has not been mentioned explicitly in the Indian Constitution, however as per the 9 th entry of the State list in the Seventh Schedule – “Relief of the disabled and unemployable” has been described as the state subject. Similarly, entry 15 of the Concurrent List mentions about “Vagrancy”.

Various provisions under the Indian Constitution such as Article 41 of Directive Principles of State policy guides the state to carry out welfare measures in its own capacity. Likewise, Article 23 of the constitution provides prohibition of human trafficking and forced labour.

Also, section 363-A of the Indian Penal Code treats acts of kidnapping, or maiming individuals for the purpose of forcing them into acts of begging as an offence. Anti-begging acts across states also seek to curb this practice, however, it has come under criticism by the Supreme Court of India due to cases of arbitrary nature of detention of these poor individuals by police which the court claims to be in violation of Article 14 and Article 21.

In terms of policies and schemes, previous governments have worked out various measures to address different aspects of the begging problem such as poverty alleviation, rehabilitation, and care through National Urban Livelihoods Mission (NULM), Swadhar Greh Scheme, Antyodaya Anna Yojana (AAY), Deendayal Antyodaya Yojana-National Urban Livelihoods Mission (DAY-NULM) and National Rural Livelihoods Mission (NRLM) among others.

However, the impact of these schemes and policies has been mostly limited due to overlapping of schemes, limited coverage, lack of proper implementation and oversight and lack of awareness among various other reasons.

In this context, Ministry of Social Justice at present is working to implement the Support for Marginalised Individuals for Livelihood and Enterprise (SMILE Scheme) at a wider scale which seeks to provide welfare measures for transgender persons and persons who are engaged in the acts of begging with a comprehensive focus on rehabilitation, provision of medical facilities, counselling, education, skill and capacity building, economic linkages etc. If the efforts are successful, it would immensely help India in achieving its target to meet the sustainable development goals (SDGs) by 2030.

Begging in India: Way forward

To address the issue of beggars in India multi-level engagements are required. At government level, long-term poverty alleviation programmes must be implemented effectively by identifying targeted population, reducing overlapping schemes, creating monitoring systems to ensure rehabilitation and shelter homes are properly built on time. Lowering cost of essential goods for these groups through public-private partnerships by utilising CSR funds is also a possible alternative.

On the other hand, citizens can help these vulnerable groups in their own capacity by not directly donating money as doing so promotes the very problem we disapprove of. Likewise, participating in NGOs as volunteers, spreading awareness to change apathetic public perception towards the problem and holding the government and authorities accountable can make a significant long-term impact.

Indian Beggar Article , Essay , Situation : He is seen on roads we drive. He is seen on the pathways we walk. He is seen on stations. He is seen seeking shelter under a broken roof. He belongs to the Indian history. He is either looked with pity or with disgrace. He has taken the bottom most position when it comes to class. He is usually not welcomed by many. He is asked to go away before even coming inside. His shaggy beard, torn clothes, dirty bag and a bowl for the coins brings a frown to many people’s face.

The Indian beggar plays a significant role in the Indian society. He goes to a varied kind of people of which a minority spare him a few coins. Those coins don’t even reach to buy a bottle of water for a day. At the end of the day, his profession tires him out. He tallies his coins to buy the bread for his toil. His family awaits his arrival. Even though it is just bread and water, they share and enjoy the food for the day. The day repeats again when the sun rises. This is a common and saddening situations in our daily lives. We never looked further and behind those tattered dress they wear.

However, India is a land of variety. So is the scenario with beggars too. Take another situation. A recent report talks about a man. A man named Pappu Kumar. He is a beggar by profession. He can be seen begging on the railway stations of Pune. Not until recently the police took him to custody. When enquired, it was known that Pappu Kumar has a land worth Rs. 1.25 Crore. He earned a massive amount by begging for alms for many years.

People as such are also encouraged amongst the begging community. Because of the helping mentality of a large amount of people in India, such criminals get a boost and consider it as a business. This hence deprives the people in the society who actually need help. The Indian beggar is always not a HE. Majority of the people roaming the streets are women and children. Their condition is even more tragic. For a day’s milk for her baby, she roams the city asking from shop after shop. She approaches the people who ignore her. Even the children aged from 6 to 14 years are seen in gangs. When they lose their hope in people, they indulge in thieving and robbery. Petty thefts get them held under police custody and they are send to juvenile homes. Just an act from your side, can change all these.

Beggars are very common in India. We see them everywhere. They can be seen at the bus stop, railway station, temple, and at all public places. They make appeals to you. They try to touch your heart.

There are hundreds of varieties of beggars in India. Some varieties are of blind beggars. As they are unable to see and do any work so they start begging. Such a type of beggars does deserve our pity. Also, there are beggars who are cripples and lepers. They are unable to earn their livelihood. Actually, all beggars have their novel methods of begging to get alms from people.

At the same time, there are beggars, both young and stout, but have opted to beg as their profession. Then there are beggars who like sadhus, but actually, they are not. Most of such type beggars are drunkards, sinners, and thieves.

There are others who simply pose to be disabled. In fact, they are not they have printed cards with them. They show it to the people. They pretended to be dumb. A number of small children move from one bazaar to another bazaar asking for some money. Actually, these are the kinds of professional beggars who also indulge them in the habit of begging. Sometimes, they are the agents of a cheat who gets his work out of them. This is being done in an organized way. The cheats make a lot of money.

Ladies, both old and young, take pity on such type of begging. Children and give them some coins. You can even see these begging children smoking or enjoying ice candy. No doubt, these are the sons and daughters of professional beggars, yet they won't do any other job but begging. If you offer these children some light job they won't do it. They would simply live on begging.

The beggars live in colonies outside a town. The colonies are in very dirty localities. All sorts of vices are practiced there while the woman goes out begging her husband to gamble and drink. In fact, all of them remain free. An Indian beggar starts his day from a place of worship. There he gets a few coins. Some religious-minded people w\even give them sweets, fruits, etc. So these beggars have their breakfast also there. Then in the afternoon, they would go to the streets. Some house ladies give them food while others oblige them with old clothes.

Beggars are a great nuisance in India. Certain states have made laws against begging. The government has made homes free of really disabled and deserving persons. But they do not like to live there.

There are some genuine beggars also like blind, cripples, and lepers. We should not encourage begging. The people in India need to be educated against this social vice.

They have many ways and means of begging. They may go about as a pretended sadhu. They keep the bowl in his hand and chants a few blessings. They deceive the ladies, They may sing some holy songs on his musical instrument. The children and women welcome such types of beggars. If they have a good voice, they earn a lot.

The beggar may sit just by the roadside. They may pretend to be deaf and blind. If they are actually blind , they may begin the name of blindness . Thus they raise the pity of people. In some cases, they may have a child or two who are clad in dirty rags. They cry and weep as if they were very hungry.

The people in India are religious minded. They think if they do good acts, God would be pleased with them.

The beggars are idlers. They cause a great loss of labor to the nation. Their manual labor could have been utilised in factories and mills. They would have produced useful work. The healthy beggars should not be given alms.

We stop to talk to a friend for a minute and he is there. We go to a shop to buy something and he is there too. There is no escape from him. There are two classes of beggars.

First there are those who are strong and able bodied men. They can work as well as anyone of us. But they do not work for their living because they find it easier to live on the charity of others. No alms should be given to such beggars. Then there are those who are old and weak and even disabled.

Such beggars should be pitied and helped. They should be provided with food and clothing. The Indian beggar is an object of pity. He has no means of earning his livelihood. He lives by begging. He goes about quiet naked except for a small lion-cloth.

His body is covered with dirt and ashes. His hair is long and dirty. He never washes his face and hands because he thinks that the dirtier he looks, the more the people will pity him. He carries a begging bowl made of clay. He goes from shop to shop begging for food or money.

There are very few people who receive him well. When he goes to them for alms. They sometimes abuse him, even beat him and turn him out of doors. It is only women who show him some mercy. They think that alms given to poor will bring them blessings in the next life.

Some beggars are really lazy and wicked fellows. They commit thefts at night. Such beggars should be given nothing. They should be caught and punished. They should be made to work for their living like honest people.

India was once known as the ‘Golden Bird’. It was not only the center of trade and exchange but also of academics and learning. People came from far and wide to witness the magnificence of India. This all changed after the advent of the British. The British wanted to gain this golden bird and trap her forever.

They exploited her, suppressed her and oppressed her. The golden bird fought and defied the British rule. She wanted to get out of her shackles. On 15 th of August, 1947 , she succeeded in getting rid of her shackles. She was able to fly again. But, by the time India got independence, she was not golden anymore. Years of foreign rule had left her poor and destitute.

After 70 years of gaining independence, India has now become the 6 th largest economy in the world, and will soon beat its own oppressor, ‘Great’ Britain. It is the largest and perhaps the most vibrant democracy in the world. India has come a long way since its independence, which is truly commendable.

But there are still some issues and problems that India faces even now. The shackles of oppression are replaced by many other shackles that hold back India from flying high. One such shackle is the problem of beggary in India.

A beggar is a homeless person who begs for food and money from other people and lives through this money and food. A person begs because she has no choice but to do so. She is homeless, and cannot gain employment due to many reasons. Maybe she is disabled or crippled.

Maybe she is so old that her body does not allow her to work. Such a person has no option but to beg. There is no other way in which she can live.

Thus, she becomes a beggar, helpless due to her unfavourable circumstances. This is why people resort to begging. But the situation in India is far from this. In India, begging has become somewhat of a profession.

Begging as a Profession in India

Begging in India is an age old practice. Begging even has religious sanction in some situations. Sadhus and Fakirs live charity. It is their way. Since childhood, as Indians, we have been taught to give charity with the one hand while the other does not come to know.

We have been taught to be kind and give charity to those who need it. We have been taught to share what god has blessed us with. Perhaps, it is this nature of the Indian morals and values that people who make begging their profession, take advantage of.

Begging is now not only done by people who are desperate and destitute or Sadhus and Fakirs, but also by able- bodied people, families and gangs who have made it their profession. It is common sight in India to find a family of husband and wife, along with their children to cry and beg for money in railway station, traffic lights, roads, outside temples, malls, shops, etc.

Many children who beg often carry another small child. Some others are crippled, while others won’t leave a person till they get some money. This is done to garner sympathy. In this way, parents, who themselves do not work use their children to ‘earn’ money by begging.

They not only play with the children’s future and deprive them of education and childhood, but also raise citizens who will grow up and do the same thing, as they do not know how to do anything else.

Begging thus deprives the country of talent, resources and productive citizens. If these three elements are not present, how can India as a country develop?

In India, begging gangs also exist. People who make begging their profession form local gangs to further their begging. As their gang becomes strong, no one goes against them. These gangs commit various crimes too to earn money through begging.

People’s hearts melt when they see a helpless young child with bleak eyes and dirty and tattered clothes. To take advantage of this fact, these gangs steal very young children from their homes and parents and scare them, punish them and train them on how to beg. Such children are so young that they don’t even remember their homes, and sometimes even the city that they belong to.

Every day, these gangs take these children to various locations like traffic signals, temples etc., to beg and get money. At the end of the day, they take away the money that the children have and if they could not collect more than a certain amount, they beat and harass these children.

When it seems that a child is unable to earn a certain amount daily, these gangs cripple the child, by cutting off a hand or leg, making the child blind, etc., so that the child can garner more sympathy and money from the people she begs from. Such is the cruelty that these innocent children have to face. This is the bleak reality of beggars and the ‘begging industry’ in India.

These gangs often bribe the officials and police officers who thus ignore the plight of the children. The children are thus caught in a spiral of misfortune and doom with no way out. They become helpless and have no choice but to obey their abductors. Some poor families even sell their children to these gangs. The future of the child is completely destroyed. Such is the nature of beggary in India.

Beggary also promotes laziness. Able bodied people who do not want to work live on charity by begging. They basically leech off the society. They do not do any work and just live off charity, when they can work. They become a menace and a burden to the society.

Then what can be done? Of course, beggary has to be done away with. Begging helps no one. Begging is also demeaning. When people see able bodied people begging when employment is available, they should not give money away to such people.

Rather than giving money to children who beg, people should give these children food, or other resources. When they see a young child begging, they should inform the police or call child welfare services. Such children should be helped and rehabilitated.

Old and crippled people who have no one they can depend on, should be helped by rehabilitating them old age care centers, NGOs, etc. The government should form stringent laws against beggary in India. The underground that operate and thrive through beggary should be caught and its members should be severely punished.

Officials and police officers who took bribes should be suspended and punished. And, to prevent people from resorting to beggary again, the government needs to make and implement poverty alleviation policies for the betterment of the whole society.

We, as citizens of India need to be careful and alert too. After governments implements stringent laws, we need to report about beggars to the police. We need to report to the police about children around us that we see are begging. They need our help. It is our duty to help them.

Even in our ancient texts and teachings it is written that charity is a noble task, but charity should be given only to people who actually require and need it. Providing charity to people who can work is condoning their laziness. There is also another popular saying, ‘God helps those who help themselves’, which is indeed true.
