Sebelum munculnya teknologi modern yang membuat komunikasi begitu mudah, pada dasarnya seni menulis surat dianggap sebagai persyaratan penting. Bahkan hari ini ketika teknologi komunikasi telah berkembang pesat, surat masih menjadi salah satu sarana komunikasi, terutama yang berkaitan dengan kegiatan yang sifatnya resmi seperti dalam melaporkan hasil penelitian. Adapun salah satu bentuk surat resmi adalah surat tugas.

Yang pasti, surat tugas digunakan sebagai penjelasan serta penegasan atas yang mewakili jika pihak pertama tidak bisa hadir atau berhalangan atas suatu hal, sehingga pihak pertama memberikan amanah atau madat kepada pihak kedua yang dia tunjuk untuk mewakilinya.

Surat Tugas

Surat penugasan merupakan pesan tertulis yang dapat ditulis tangan atau dicetak di atas kertas. Pembuatan surat ini biasanya dikirim ke penerima melalui surat atau pos dalam amplop, meskipun hal tersebut persyaratan mutlak. Alasannya karena pesan apa pun yang ditransfer melalui pos adalah surat, lantaran ada percakapan tertulis antara dua pihak.

Bahkan pada era sekarang setelah E-mail dan teks serta bentuk-bentuk lainnya telah menjadi norma untuk komunikasi, seni menulis surat telah mengambil kursi belakang. Namun, bahkan hari ini masih banyak komunikasi kita, terutama yang formal, dilakukan melalui surat.

Pengertian Surat Tugas

Surat tugas adalah jenis surat resmi yang senantisa dibuat dan dikeluarkan oleh seorang pejabat yang berwenang di instansi atau lembaga tertentu yang isinya memberikan penugasan kepada seorang pegawai/staff untuk melakukan suatu pekerjaan.

Pengertian Surat Tugas Menurut Para Ahli

Adapun definisi surat tugas menuurt para ahli, antara lain:

  • Dictionary of International Trade , Surat penugasan ( letter of assignment ) adalah dokumen yang digunakan oleh pemberi tugas untuk memberikan hak kepada pihak ketiga.
  • Wikiapbn , Surat Tugas atau ST ialah naskah dinas yang dibuat oleh pejabat yang berwenang kepada pejabat atau pegawai lain yang diberi tugas yang memuat apa yang harus dilakukan. Surat tugas digunakan untuk melaksanakan kegiatan kedinasan dalam jangka waktu tertentu, seperti perjalanan dinas dalam negeri.

Ciri Surat Tugas

Surat tugas memiliki beberapa karakteristik, antara lain:

  • Di dalam surat tugas harus dijelaskan tentang adanya penugasan dari pimpinan kepada seorang pegawai/ staf untuk pekerjaan tertentu
  • Surat tugas menggunakan bahasa yang baku atau resmi, dimana isinya dibuat dengan singkat, padat, dan jelas
  • Di dalam surat tugas harus dilengkapi dengan kop surat, judul surat, nomor surat, isi surat, tanggal, nama dan tanda tangan pejabat pemberi tugas, nama dan tanda tangan penerima tugas
  • Surat tugas harus dibubuhi dengan stempel instansi yang bersangkutan

Macam Surat Tugas

Terdapat bermacam-macam surat tugas sesuai dengan keperluasn dari seseorang atau instansi yang bersangkutan. Berikut ini beberapa contoh surat tugas, baik surat tugas dari instansi maupun perorangan, antara lain:

Fungsi Surat Tugas

Surat tugas berfungsi sebagai:

  • Dokumen pengesahan formal bagi pengemban tugas terhadap tugas yang harus dijalankan

Surat yang dikeluarkan oleh instansi atau pihak yang lebih tinggi dan ditujukan kepada pihak bawahan untuk melaksanakan tugas tertentu dianggap sebagai lembar pengesahan yang formil. Sehingga atas dasar inilah fungsinya memberikan rujukan kepada khalayak umum.

  • Surat untuk membantu mempermudah tugas pejabat pelaksana tugas dalam berhubungan dengan instansi atau lembaga yang berhubungan dengan tugasnya tersebut

Proses mempemudah dalam fungsi surat tugas tentusaja berkaitan dengan kepentingan yang ada di insitusi atau lembaga yang dituju. Sehingga melalui peran inilah tak lain untuk mendeskripsikan betapa pentingnya surat yang dibuat.

Tujuan Surat Tugas

Adapun untuk beberapa tujuan pembuatan surat tugas. Antara lain;

  • Bukti Legal di Mata Hukum

Tujuan surat tugas tak lain ialah sebagai salah satu bukti legal atas penugasan seorang pejabat atas suatu pekerjaan sesuai dengan isi surat tersebut. Sehingga bukti ini kadangkala memberikan efek positif kepada pihak terkait untuk memberikan persetujuan.

Syarat Penulisan Surat Tugas yang Baik

Karena surat tugas merupakan salah satu bentuk surat fomal, sehingga dalam pernyusunannya harus memperhatikan kaidah yang baik dan benar. Penjelasan ini terkait dengan bahasa, yaitu:

  • Bahasa baku; Bahasa jelas atau tidak bermakna ganda
  • Lugas: tidak mubazir, tidak banyak basa-basi, mengikuti perkembangan bahasa surat
  • Efektif dan efisien

Disisi lain, untuk penyusunan dan penandatanganan surat tugas dilakukan oleh pejabat yang berwenang berdasarkan pada lingkup tugas, wewenang, dan tanggung jawabnya. Surat Tugas disampaikan kepada yang mendapat tugas. Tembusan disampaikan kepada pejabat/instansi yang terkait.

Dalam menyusun surat tugas, terdapat beberapa hal yang diperhatikan, antara lain:

  • Surat Tugas tidak menggunakan konsiderans.
  • Apabila Surat Tugas berupa tugas kolektif, maka daftar pegawai yang diberi tugas harus dimasukkan ke dalam lampiran yang terdiri atas kolom nomor urut, nama, pangkat, NIP, jabatan, dan keterangan.
  • Surat Tugas ditetapkan oleh atasan pegawai, kecuali jika dikarenakan ada pertimbangan tertentu, pejabat tersebut diberi wewenang tertulis untuk menetapkan Surat Tugas bagi dirinya sendiri.
  • Surat Tugas tidak berlaku lagi setelah tugas selesai dilaksanakan.

Cara Membuat Surat Tugas

Berikut ini beberapa tips untuk penulisan surat secara umum, yaitu:

Identifikasi jenis huruf

Ini adalah langkah pertama dari proses penulisan surat. Anda harus dapat mengidentifikasi jenis surat yang akan Anda tulis. Misalkan Anda menulis surat kepada kepala sekolah untuk meminta cuti, maka ini termasuk surat resmi. Sedangkan jika Anda sedang menulis surat untuk profesor lama Anda setelah sekian lama. Maka ini akan menjadi surat pribadi (informal).

Pastikan Anda membuka dan menutup surat dengan benar

Membuka surat dengan cara yang benar sangat penting. Surat formal terbuka dengan struktur dan salam khusus yang sifatnya formal. Surat-surat informal dapat dialamatkan ke nama orang atau salam informal apa pun sesuai keinginan penulis.

Bahkan ketika menutup surat itu, harus diingat jenis surat apa yang sedang ditulis. Surat formal berakhir dengan hormat dan tidak pribadi, sedangkan surat informal dapat berakhir dengan sentuhan yang lebih pribadi.

Tetapkan maksud/tujuan utama surat itu

Setelah anda mulai menulis surat tugas haruslah dapat pastikan untuk langsung ke intinya sesegera mungkin. Khususnya dalam surat formal, hal ii penting untuk segera memperjelas tujuan surat tugas tersebut kepada pihak terkait.

Hati-hati dalam penggunaan bahasa

Sebuah surat selalu dianggap sopan dan penuh perhatian. Bahkan jika itu adalah surat pengaduan, intinya harus dibuat dengan hati-hati dan sopan. Jadi perlu untuk menggunakan ekspresi sopan dan bahasa Indoneisa yang baik dan benar di semua jenis surat.

Panjang surat

Dan faktor penting lainnya yang harus dipertimbangkan adalah panjangnya surat yang Anda tulis. Perlu diingat bahwa surat-surat formal pada umumnya  to the point , tepat dan pendek. Surat formal yang panjang cenderung tidak memiliki efek yang diinginkan pada pembaca. Panjang surat informal ditentukan oleh pesan dalam surat dan hubungannya dengan penerima.

Sedangkan secara spesifik, dalam membuat surat tugas, terdapat beberapa bagian yang harus dibuat secara berurutan. Berikut ini urutan cara membuat surat tugas yang baik dan benar, yaitu:

Kepala Surat Tugas

Bagian kepala Surat Tugas terdiri atas:

  • Kepala naskah dinas, berisi logo dan nama instansi, yang diletakkan secara simetris dan ditulis dengan huruf kapital
  • Tulisan Surat Tugas yang diletakkan di bawah kepala dengan huruf kapital, yang diikuti nomor Surat Tugas ditulis secara simetris di bawahnya

Batang Tubuh Surat Tugas

Bagian batang tubuh Surat Tugas terdiri atas:

  • Alasan penugasan yang diikuti dengan kata menugasi kepada para pejabat/pegawai yang mendapat tugas (nama, NIP, pangkat/golongan, dan jabatan). Di bawahnya memuat tugas yang harus dilaksanakan serta jangka waktu pelaksanaan kegiatan;
  • Penutup yang memuat perintah pelaksanaan tugas, menyampaikan laporan, dan bila diperlukan diikuti dengan permintaan bantuan pihak terkait untuk memudahkan pelaksanaan tugas.

Kaki Surat Tugas

Bagian kaki surat tugas terdiri atas:

  • Tempat dan tanggal penetapan Surat Tugas
  • Nama jabatan pejabat yang menandatangani Surat Tugas, yang ditulis dengan huruf awal kapital, dan diakhiri dengan tanda baca koma (,)
  • Tanda tangan pejabat yang memberi tugas
  • Nama lengkap pejabat yang menandatangani Surat Tugas, yang ditulis dengan huruf awal kapital
  • NIP pejabat yang memberi tugas, kecuali untuk Menteri Keuangan
  • Tembusan (bila diperlukan)

Dari penjelasan yang dikemukakan dapatlah dikatakan bahwa dalam menulis surat, meskipun hanya terdiri dari satu atau dua lembar saja, kita tidak boleh sembarangan dalam membuatnya, terutama untuk surat-surat yang sifatnya resmi atau formal, termasuk surat tugas.

Sehingga baik itu surat pengantar untuk pekerjaan, atau bank yang mengirimi Anda pengingat atau surat penerimaan perguruan tinggi, surat-surat masih merupakan cara komunikasi yang penting. Itulah sebabnya penting bagi kita untuk mengetahui seluk-beluk penulisan surat.

Oleh karena itulah surat tugas dapat diartikan sebagai surat resmi yang wajib digunakan dalam administrasi untuk melimpahkan mandat atau amanah. Surat tugas dapat didefinisikan sebagai surat yang dikeluarkan oleh instansi atau pihak yang memiliki jabatan lebih tinggi yang ditujukan kepada  pihak bawahan untuk melaksanakan suatu tugas tertentu.

Hal tersebut menunjukkan bahwa ternyata surat tugas bukan hanya dikeluarkan oleh instansi atau lembaga pemerintahan dan swasta, tapi ini bisa juga dibuat oleh organisasi atau individu.

The assignment letter, an editor’s best friend.

Sure, you and the writer had a long talk when you commissioned that story idea. But two months later the manuscript is on your desk, and who can remember what the article was supposed to be? That’s where an assignment letter comes in handy. After you and a freelancer have agreed on a story, recap the discussion in writing and send your letter (or e-mail message) to the writer. It will help you get the piece you want.

Once you’ve read through the guidelines below, have a look at our sample letter (a downloadable PDF document).

WHY WRITE IT?

  • To build an editorial foundation for the story: A clear assignment letter puts you and the writer on the same wavelength. If your written description differs from the writer’s recollection, you have a chance to resolve the discrepancy before the first draft comes in. And when the manuscript arrives, the letter allows you to judge whether the writer delivered the story as promised. You can also circulate the letter to higher-ups to make sure they buy into the assignment and recall it later. When you distribute the manuscript to other editors for review, attach the letter so they too know what the idea was.
  • To build a relationship with a writer: Writers want clear instruction; an assignment letter provides that and gives the writer something to refer to while reporting and writing. A careful summary of the story idea assures the writer that you’re a careful editor who wants to prevent those nasty surprises that so often pop up between writer and editor. The letter also lets you address a writer’s weaknesses—get two sources for every fact, avoid clichés, and so on.

WHAT’S IN IT?

  • A clear, specific statement of the story’s concept, content, and approach: Quickly and specifically outline what the article will cover and the depth of information you expect, including perhaps the types of sources you desire (personal interviews, scientific studies, etc.). Send research materials you have collected. Enclose a sample story from your magazine that could serve as a model. Confirm the approach you have agreed to and, if you two have discussed them, outline the lead and structure.
  • Your worries: Is the reporting going to be difficult? Say so. Are you concerned about the structure? Ask to see an outline. Are there points that absolutely have to be covered? Make sure the writer knows.
  • Logistical information: Describe the magazine’s payment procedures, editing process, fact-checking needs; tell the writer if you’re going to be out of town and whether you prefer to work by phone or e-mail. You can create some of this information ahead of time to cut-and-paste into your assignment letters.

How to Draft an Assignment of Contract

A contract is an agreement between at least two parties—A and B. However, one party might want to transfer the contract to someone else. For example, B might want to assign its rights and obligations to C. Sometimes, a contract prohibits assignment, in which case B can’t assign the contract to anyone. In other contracts, the other party to the original contract (here Party A) must also agree to the assignment from B to C. If the contract allows assignment, then an assignment can take place once a proper assignment agreement has been created.

Starting the Assignment Agreement

Step 1 Format your document.

  • If you are printing the agreement on letterhead, make sure to leave enough room at the top.

Step 3 Identify the parties.

  • Sample language could read, “This Assignment (‘Assignment’), dated as of [insert date] (‘Effective Date’), is made between [insert your name] (‘Assignor’) and [insert the name of the assignee] (‘Assignee’).” [1] X Research source

Step 4 Include your recitals.

  • Sample recitals could read, “Whereas, Assignor entered into the following Contract with [the name of the party you contracted with, called the ‘obligor’] on [insert date of the contract] (‘Contract’); and whereas Assignor wishes to assign all of its rights and obligations under the Contract to Assignee. Now, therefore, Assignor and Assignee agree as follows.”

Granting the Assignment

Step 1 Assign all rights and obligations.

  • A sample grant could read: “Assignor and Assignee hereby agree that the Assignor shall assign all its title, right, and interest, and delegate all its obligations, responsibilities, and duties, in and to the Contract to Assignee.”

Step 2 Include an acceptance by the assignee.

  • “Assignee hereby accepts the assignment of all of Assignor’s obligations, responsibilities, and duties under the Contract and all of Assignor’s right, title, and interest in and to the Contract.”

Step 3 Explain how to modify the assignment.

  • A sample modification provision could read: “This Agreement may only be modified if the modification is made in writing and executed by both Assignor and Assignee. No verbal agreement is allowed.”

Step 4 Allocate indemnification.

  • The assignor could agree to indemnify the obligor: “Assignor agrees to defend and indemnify [insert name of the obligor] from any and all claims, judgments, actions, proceedings, liabilities, and costs, including reasonable attorneys’ fees and other costs of defense and damages, resulting from Assignor’s performance prior to the assignment of the Contract and resulting from Assignee’s performance after the assignment of the Contract. However, after the assignment of the Contract, [insert name of the obligor] shall first look to Assignee to satisfy all claims, actions, judgments, proceedings, liabilities, and costs, including reasonable attorneys’ fees and other costs of defense and damages resulting from Assignee’s performance.”
  • The assignee should also agree to indemnify the obligor: “Assignee agrees to indemnify the [insert name of obligor] from any and all claims, judgments, actions, proceedings, liabilities, and costs, including reasonable attorneys’ fees and other costs of defense and damages, resulting from Assignee’s performance after the assignment of the Contract.”

Finalizing the Agreement

Step 1 Identify the governing law.

An assignment agreement is a legal document that transfers rights, responsibilities, and benefits from one party (the “assignor”) to another (the “assignee”). You can use it to reassign debt, real estate, intellectual property, leases, insurance policies, and government contracts.

An assignment agreement effectively transfers the rights and obligations of a person or entity under an initial contract to another. The original party is the assignor, and the assignee takes on the contract’s duties and benefits.

It’s often a requirement to let the other party in the original deal know the contract is being transferred. It’s essential to create this form thoughtfully, as a poorly written assignment agreement may leave the assignor obligated to certain aspects of the deal.

The most common use of an assignment agreement occurs when the assignor no longer can or wants to continue with a contract. Instead of leaving the initial party or breaking the agreement, the assignor can transfer the contract to another individual or entity.

For example, imagine a small residential trash collection service plans to close its operations. Before it closes, the business brokers a deal to send its accounts to a curbside pickup company providing similar services. After notifying account holders, the latter company continues the service while receiving payment.

Create a thorough assignment agreement by including the following information:

  • Effective Date:  The document must indicate when the transfer of rights and obligations occurs.
  • Parties:  Include the full name and address of the assignor, assignee, and obligor (if required).
  • Assignment:  Provide details that identify the original contract being assigned.
  • Third-Party Approval: If the initial contract requires the approval of the obligor, note the date the approval was received.
  • Signatures:  Both parties must sign and date the printed assignment contract template once completed. If a notary is required, wait until you are in the presence of the official and present identification before signing. Failure to do so may result in having to redo the assignment contract.

Review the Contract Terms

Carefully review the terms of the existing contract. Some contracts may have specific provisions regarding assignment. Check for any restrictions or requirements related to assigning the contract.

Check for Anti-Assignment Clauses

Some contracts include anti-assignment clauses that prohibit or restrict the ability to assign the contract without the consent of the other party. If there’s such a clause, you may need the consent of the original parties to proceed.

Determine Assignability

Ensure that the contract is assignable. Some contracts, especially those involving personal services or unique skills, may not be assignable without the other party’s agreement.

Get Consent from the Other Party (if Required)

If the contract includes an anti-assignment clause or requires consent for assignment, seek written consent from the other party. This can often be done through a formal amendment to the contract.

Prepare an Assignment Agreement

Draft an assignment agreement that clearly outlines the transfer of rights and obligations from the assignor (the party assigning the contract) to the assignee (the party receiving the assignment). Include details such as the names of the parties, the effective date of the assignment, and the specific rights and obligations being transferred.

Include Original Contract Information

Attach a copy of the original contract or reference its key terms in the assignment agreement. This helps in clearly identifying the contract being assigned.

Execution of the Assignment Agreement

Both the assignor and assignee should sign the assignment agreement. Signatures should be notarized if required by the contract or local laws.

Notice to the Other Party

Provide notice of the assignment to the non-assigning party. This can be done formally through a letter or as specified in the contract.

File the Assignment

File the assignment agreement with the appropriate parties or entities as required. This may include filing with the original contracting party or relevant government authorities.

Communicate with Third Parties

Inform any relevant third parties, such as suppliers, customers, or service providers, about the assignment to ensure a smooth transition.

Keep Copies for Records

Keep copies of the assignment agreement, original contract, and any related communications for your records.

Here’s a list of steps on how to write an assignment agreement:

Step 1 – List the Assignor’s and Assignee’s Details

List all of the pertinent information regarding the parties involved in the transfer. This information includes their full names, addresses, phone numbers, and other relevant contact information.

This step clarifies who’s transferring the initial contract and who will take on its responsibilities.

Step 2 – Provide Original Contract Information

Describing and identifying the contract that is effectively being reassigned is essential. This step avoids any confusion after the transfer has been completed.

Step 3 – State the Consideration

Provide accurate information regarding the amount the assignee pays to assume the contract. This figure should include taxes and any relevant peripheral expenses. If the assignee will pay the consideration over a period, indicate the method and installments.

Step 4 – Provide Any Terms and Conditions

The terms and conditions of any agreement are crucial to a smooth transaction. You must cover issues such as dispute resolution, governing law, obligor approval, and any relevant clauses.

Step 5 – Obtain Signatures

Both parties must sign the agreement to ensure it is legally binding and that they have read and understood the contract. If a notary is required, wait to sign off in their presence.

Brief history of different grading systems

In 1785, students at Yale were ranked based on "optimi" being the highest rank, followed by second optimi, inferiore (lower), and pejores (worse). At William and Mary, students were ranked as either No. 1, or No. 2, where No. 1 represented students that were first in their class, while No. 2 represented those who were "orderly, correct and attentive." Meanwhile at Harvard, students were graded based on a numerical system from 1-200 (except for math and philosophy where 1-100 was used). Later, shortly after 1883, Harvard used a system of "Classes" where students were either Class I, II, III, IV, or V, with V representing a failing grade. All of these examples show the subjective, arbitrary, and inconsistent nature with which different institutions graded their students, demonstrating the need for a more standardized, albeit equally arbitrary grading system.

In 1887, Mount Holyoke College became the first college to use letter grades similar to those commonly used today. The college used a grading scale with the letters A, B, C, D, and E, where E represented a failing grade. This grading system however, was far stricter than those commonly used today, with a failing grade being defined as anything below 75%. The college later re-defined their grading system, adding the letter F for a failing grade (still below 75%). This system of using a letter grading scale became increasingly popular within colleges and high schools, eventually leading to the letter grading systems typically used today. However, there is still significant variation regarding what may constitute an A, or whether a system uses plusses or minuses (i.e. A+ or B-), among other differences.

An alternative to the letter grading system

Letter grades provide an easy means to generalize a student's performance. They can be more effective than qualitative evaluations in situations where "right" or "wrong" answers can be easily quantified, such as an algebra exam, but alone may not provide a student with enough feedback in regards to an assessment like a written paper (which is much more subjective).

Although a written analysis of each individual student's work may be a more effective form of feedback, there exists the argument that students and parents are unlikely to read the feedback, and that teachers do not have the time to write such an analysis. There is precedence for this type of evaluation system however, in Saint Ann's School in New York City, an arts-oriented private school that does not have a letter grading system. Instead, teachers write anecdotal reports for each student. This method of evaluation focuses on promoting learning and improvement, rather than the pursuit of a certain letter grade in a course. For better or for worse however, these types of programs constitute a minority in the United States, and though the experience may be better for the student, most institutions still use a fairly standard letter grading system that students will have to adjust to. The time investment that this type of evaluation method requires of teachers/professors is likely not viable on university campuses with hundreds of students per course. As such, although there are other high schools such as Sanborn High School that approach grading in a more qualitative way, it remains to be seen whether such grading methods can be scalable. Until then, more generalized forms of grading like the letter grading system are unlikely to be entirely replaced. However, many educators already try to create an environment that limits the role that grades play in motivating students. One could argue that a combination of these two systems would likely be the most realistic, and effective way to provide a more standardized evaluation of students, while promoting learning.
