ইসলামী আইন ও বিচার পত্রিকা (E-ISSN 2518-9530; ISSN-1813-0372) বাংলাদেশ সরকার কর্তৃক নিবন্ধিত (রেজি. নং: DA-6100) বাংলাদেশ ইসলামিক ল’ রিসার্চ এন্ড লিগ্যাল এইড সেন্টার-এর একটি ত্রৈমাসিক একাডেমিক রিসার্চ জার্নাল। যা প্রতি তিন মাস অন্তর, (জানুয়ারি-মার্চ, এপ্রিল-জুন, জুলাই-সেপ্টেম্বর, অক্টোবর-ডিসেম্বর) প্রিন্ট ভার্সনের পাশাপাশি অনলাইন ভার্সনও নিয়মিত প্রকাশিত হচ্ছে। এ জার্নালে জড়িত রয়েছেন একটি দক্ষ এডিটরিয়াল বডি, অভিজ্ঞ সম্পাদনা পরিষদ এবং জাতীয় ও আন্তর্জাতিক শিক্ষাবিদগণের সমন্বয়ে একটি উচ্চ ক্ষমতাসম্পন্ন এডভাইজারি বোর্ড। পত্রিকাটি দেশের অধিকাংশ সরকারি ও বেসরকারি বিশ্ববিদ্যালয় এবং উচ্চ শিক্ষা প্রতিষ্ঠানের সংশ্লিষ্ট বিভাগে গবেষণা পত্রিকা হিসেবে স্বীকৃত। ফলে “ইসলামী আইন ও বিচার” পোল্যান্ডভিত্তিক আন্তর্জাতিক জার্নাল রেটিং প্রতিষ্ঠান Index Copernicus Gi ICI Journals Master List এ বিগত কয়েক বছরের ন্যায় এবারো তাদের রেটিং পেয়েছে এবং ইউনেস্কোর অধিভুক্ত কমিউনিকেশন এন্ড ইনফরমেশন সেক্টর এবং ISSN ইন্টারন্যাশনাল সেন্টারের যৌথ পরিচালিত ROAD, the Directory of Open Access Scholarly Resources  এবং Google Scholar ডাটাবেজ এ অন্তর্ভুক্ত রয়েছে। এবছর Digital Object Identifier System (DOI) এর অন্তর্ভুক্ত হওয়ার মাধ্যমে আন্তর্জাতিক মানের গবেষণা জার্নালে উন্নীত হয়েছে। এমতাবস্থায় জার্নালে প্রকাশের জন্য দেশ-বিদেশের বাংলাভাষী শিক্ষাবিদ, আইনবিদ, অধ্যাপক ও গবেষকগণকে গবেষণা প্রবন্ধ/বুক রিভিউ প্রেরণের অনুরোধ করা হচ্ছে। প্রবন্ধ প্রণয়নের উদ্দেশ্য প্রবন্ধ প্রণয়নের ক্ষেত্রে নিম্নোক্ত উদ্দেশ্যসমূহ বিবেচনায় আনতে হবে: ক. আইন ও বিচারসহ সামগ্রিক ইসলামী বিধান সম্পর্কে জনমনে আগ্রহ সৃষ্টি করা ও গণসচেতনতা তৈরি করা; খ. ইসলামী জীবনবিধান সম্পর্কে পুঞ্জিভূত বিভ্রান্তি দূর করা; গ. মুসলিম শাসনামলের ইসলামী আইন ও বিচারের প্রায়োগিক চিত্র তুলে ধরা; ঘ. সমসাময়িক ও নতুন নতুন সমস্যার ইসলামী সমাধান উপস্থাপন; ঙ. সমাজের সর্বস্তরে ইনসাফ ও মানবাধিকার নিশ্চিত করার লক্ষ্যে প্রচলিত ব্যবস্থার ঘাটতি ও ত্রুটিগুলো চিহ্নিত করে সংস্কারের সুপারিশ পেশ। প্রবন্ধের বিষয়বস্তু (১) এ জার্নালে ইসলামের অর্থনীতি, সমাজনীতি, রাষ্ট্রনীতি, আইনতত্ত্ব, বিচারব্যবস্থা, ব্যাংক, বীমা, শেয়ারব্যবসা, আধুনিক ব্যবসায়-বাণিজ্য, ফিক্হশাস্ত্র, ইসলামী আইন, মুসলিম শাসকদের বিচারব্যবস্থা, মুসলিম সমাজ ও   বিশ্বের সমসাময়িক সমস্যা ও এর ইসলামী সমাধান এবং তুলনামূলক আইনী ও ফিকহী পর্যালোচনামূলক প্রবন্ধকে গুরুত্ব দেয়া হয়। (২) জার্নালে সর্বোচ্চ ২০০০ শব্দে গুরুত্বপূর্ণ ডকুমেন্টারি গ্রন্থ পর্যালোচনাও প্রকাশ করা হয়। এ ক্ষেত্রে ইসলামী আইন ও বিচার বিষয়ক গ্রন্থ অগ্রাধিকার দেয়া হয়। প্রবন্ধের ভাষা ও বানান রীতি    * প্রবন্ধটি বাংলা ভাষায় রচিত হতে হবে। তবে প্রয়োজনে ভিন্ন ভাষার উদ্ধৃতি প্রদান করা যাবে।    * প্রবন্ধ রচনার ক্ষেত্রে বাংলা একাডেমি প্রণীত প্রমিত বাংলা বানানের নিয়ম অনুসরণ করতে হবে, তবে আরবী শব্দের ক্ষেত্রে ইসলামী ভাবধারা অক্ষুণ্ন রাখতে হবে। পাণ্ডুলিপি তৈরি    * পাণ্ডুলিপি অবশ্যই লেখক/লেখকগণের মৌলিক গবেষণা (Original Research) হতে হবে। অন্যের লেখা থেকে গৃহীত উদ্ধৃতির পরিমাণ প্রবন্ধের একচতুর্থাংশের কম হতে হবে।    * যৌথ রচনা হলে আলাদা পৃষ্ঠায় লেখকগণের কে কোন অংশ রচনা করেছেন বা প্রবন্ধ প্রণয়নে কার অবদান কতটুকু তার বিবরণ দিতে হবে।    * প্রবন্ধের শব্দসংখ্যা সর্বনিম্ন ৩০০০ (তিন হাজার) এবং সর্বোচ্চ ৮০০০ (আট হাজার) এর মধ্যে হতে হবে।    * কম্পিউটার কম্পোজ করার জন্য বাংলা বিজয় কী-বোর্ড এর Sutonny MJ অথবা ইউনিকোড কী-বোর্ড Solaimanlipi এর ফন্ট ব্যবহার করতে হবে। প্রবন্ধের কাঠামো    * সারসংক্ষেপ: প্রবন্ধের শুরুতে ১০০-১৫০ শব্দের মধ্যে একটি সারসংক্ষেপ (Abstract) থাকতে হবে। এ সারসংক্ষেপে প্রবন্ধের উদ্দেশ্য, প্রবন্ধে ব্যবহৃত গবেষণা পদ্ধতি ও গবেষণান্তে প্রাপ্ত ফলাফল সম্পর্কে ইঙ্গিত থাকবে।    * মূলশব্দ: সর্বাধিক ৫টি মূলশব্দ (Keywords) উল্লেখ করতে হবে।    * ইংরেজি অনুবাদ: প্রবন্ধের শিরোনাম, লেখকের নাম, সারসংক্ষেপ ও মূলশব্দ বাংলার পাশাপাশি ইংরেজি অনুবাদও দিতে হবে।    * ভূমিকা: প্রবন্ধের ভূমিকায় বিষয়ের গুরুত্ব, তাৎপর্য ও প্রবন্ধ রচনার যৌক্তিকতা সংক্ষেপে উপস্থাপন করতে হবে।    * মূল আলোচনা: মূল আলোচনায় অবশ্যই লেখকের নিজস্ব চিন্তার প্রতিফলন ঘটবে এবং প্রবন্ধের বিষয়বস্তু কেন্দ্রিক হতে হবে। প্রবন্ধ প্রণয়নের ক্ষেত্রে পূর্বের সাহিত্য কর্ম থেকে কোন সহযোগিতা নেয়া হলে বস্তুনিষ্ঠতার সাথে যথাযথ উদ্ধৃতি প্রদান করতে হবে। প্রবন্ধে অনুসৃত গবেষণা পদ্ধতি অনুযায়ী যথার্থ ব্যাখ্যা-বিশ্লেষণ অন্তর্ভুক্ত হতে হবে।    * উপসংহার: প্রবন্ধ থেকে প্রাপ্ত ফলাফল, বর্তমান প্রেক্ষাপটে তা বাস্তবায়নের গুরুত্ব ও উপকারিতা এবং আইনের ইসলামিকরণে এর ভূমিকা ও সুপারিশ তুলে ধরতে হবে।

Access to Justice through Legal Aid: A Study in Bangladesh

Equal access to justice for the rich and poor alike is prerequisite to the maintenance of the rule of law. But the justice system through judicial administration is very costly in Bangladesh and that cost has been the most difficult factor for the poor and vulnerable sectors of people in case of getting justice. Thus an adequate legal aid system is one of the effective ways to ensure access to justice as well as to establish rule of law. In this paper attempts have been made to examine the present condition of the legal aid services in Bangladesh, the establishment and functions of the different legal aid committees but, importance is especially given to the local govt. level where legal aid services are provided by the District, Upazila and Union Legal Aid Committees. The study compares the role of the govt. and non- govt. organizations in dissemination of legal aid services among the people who do not manage themselves to get proper remedy due to various limitations and discriminations. After reviewing the collected data and analysis of these, it has observed that the cases to which legal aid services are provided include both the civil and criminal matters and the cases relating to family affairs. Finally conclusion is drawn after evaluating the activities of the aforesaid organizations and by making substantial recommendations to the concerned authority.

People are the actual owner of the State and persons acting in the service of the Republic are none but the servants of the people. It is a duty of the State to remove exploitation and to ensure rule of law, fundamental human rights, equality and access to justice for the citizens. But these cannot be ensured by leaving a significant number of its population below the poverty line. Legal aid is a proven process by which exploitation of the poor can be removed, and rule of law, equality and justice can be ensured for all citizens of the State. Being the owner of the State, getting legal aid is a right of the poor people, not a mercy or charity from the government. The State is under an obligation to ensure the fundamental human rights and access to justice for all citizens. The Constitution of the People's Republic of Bangladesh, the Supreme Law of the State, is the unparalleled basis of providing legal aid. It may not be possible to ensure legal aid services to the indigent, vulnerable, disadvantaged people only by enacting laws rather it can be ensured through improving and implementing the existing law. Public awareness is one of the most important mechanisms, by which public at large will be aware about their rights of equality before law and access to justice. To ensure Access to Justice and Human Rights, both governmental and non-governmental organizations need to work in collaboration with each other through raising public awareness and providing legal aid services.

The constitution of Bangladesh has not inserted directly the term of ‘free legal aid’ but through the plain interpretation of ‘equality before law’ and ‘equal protection of law’ we find free legal aid is also a constitutional right. All over the world legal aid has been identified as an efficient instrument for erasing the socio-economic disparities from the society. Bangladesh is the place where poor people are critically disadvantage people from every sort of rights. In the total territory of 56 thousand square miles, the High Court division of Apex Court, situated in the capital city Dhaka, is the only place where people can seek remedy when their fundamental right is violated. Poor people lives in a far away distance from the Apex Court. The noise of cry and long breath of poor people unable to knock the door of Judicial temple. Abstract Strengthening access to local justice for the citizens is critically important in establishing good governance. Local government institution may play an undeniable role in establishing good governance and facilitating local justice services. Union Parishad (UP) is the lowest tier of local government institutions in Bangladesh that is entrusted to run Village Courts, Arbitration Council, forming and running Union Legal Aid Committee etc. locally for its constituency. Traditional shalish run by the elderly or NGOs within the same geographical areas also plays a pivotal role in rural citizen’s life in obtaining legal remedies. Given these circumstances, the objective of this paper is to explore the local justice delivery frameworks currently existing in Bangladesh at the UP level – be it actively functional or inactively lying in paper, analyze the strengths and weaknesses of these systems and explore potentials of making the inactive mechanisms active.

With active participation of all faculties in conducting the field works, I was given the responsibility to write the final project report, present and analyse the research findings. The project involved a rigorous study into the problems facing the justice seeking people in Bangladesh with particular reference to Sylhet District Judiciary.

The Scenario of Zakah Management in Bangladesh: A Critical Analysis

The aim of the study is to describe and analyze the real scenario of zakah management in Bangladesh. Zakah is an important tool to eradicate poverty in the country and it can play a vital role in alleviating unemployment too. About 91.04% of the total population of the country is Muslim. A good number of Muslims are capable of paying zakah annually. However, the zakah management system in urban or rural areas is poor. And the capable people on whom zakah is compulsory are not so positive about distributing zakah among (mustahaqqun) the beneficiary group. Mustahaqqun means the class of people who are eligible to collect zakah according to Islamic Shariah. Almost, all the zakah payers are not aware enough to pay zakah in the defined Sariah way. Only a few people legally pay their zakah portion among the eligible class. For this, the actual method of zakah distribution management in Bangladesh is not exercised and executed properly. This is why, the real beneficiary group is not facilitated in a systematic way. This study also tries to focus on the challenges of zakah distribution management in Bangladesh and tries to highlight the effective recommendations for resolving these problems.

Goal and objectives

• To explain and present appropriateness and applicability of Islamic law before society against the backdrop of challenges of modern society and state;
• To present recommendations for reform in the existing law and justice system in the country to ensure justice;
• To provide legal aid to the oppressed;
• To encourage community people to obey the codes and instructions given by the Almighty Allah and the prophet Muhammad (PBUH);
• To build a just society through achieving the above mentioned goals
• To involve lawyers and jurists expert in current law of the country as well as the Ulama, i.e., expert in Islamic law (Islamic scholars) with Bangladesh Islamic Law Research and Legal Aid Centre
• To review and analyze the supremacy and appropriateness of Islamic law and to indicate guidelines for its application, which will be done through a comparative assessment between British law currently effective in the country and Islamic law
• To identify the problems of the modern time and to explore solutions to these problems in the light of teachings of Islam
• To write and publish time befitting features, periodicals, journals, booklets and law books on Islamic law through research on it
• To translate into Bangla and publish valuable and enlightening books on Islamic law as well as Sharia written in Arabic, Persian, Urdu and English
• To collect works written or are being written on Islamic law in different countries of the world and then publish those in Bangla
• To establish a rich library full of valuable books and journals written in Bangla, English, Arabic, Persian and Urdu
• To develop a group of researchers, expert writers and presenters on Islamic law and Sharia
• To arrange national and international seminars, symposiums and conferences with the participation of resource persons and researchers on Islamic law from home and abroad
• To identify the reasons for repression on women and children, to prevent women repression and to explain and make explicit the Islamic rules and regulations in preventing repression on women and protecting woman and child rights
• To provide legal support free of cost to needy and helpless people who are deprived of human rights
• To engage common people in elimination of social evils e.g., drug addiction, bribery, corruption, violence and dowry after making them alert and aware about such evils
• To present Islamic rules regarding rights of prisoners and detainees to ensure reform in the existing jail system of the country

Future plan

• To establish a rich library to help comprehensive researches on Islamic law
• To arrange seminars, symposiums and conferences to create awareness among mass people in favour of Islamic law and strengthen campaign about it in both electronic and print media as well as through social web networks
• To send investigation team to the spot to prevent organized propaganda against Islamic law on a particular incidence and find the fact through contacting directly with concerned people and groups of the area
• To indicate flaw and shortcomings of the current law and administrative systems of the country and to identify remedies for all types of social evils through researches and review of the society and provide good advice to the people about it
• To publish books, booklets and documentaries through a comparative assessment of Islamic idea and other ideas regarding protecting human rights particularly the rights of women and children
• To create public awareness among the common people about role of Islamic rules and regulations regarding protecting rights of religious minorities
• To take initiative for government approval for setting up of a salish (arbitration) board in the light of Islamic law in order to ease case backlog in the judiciary and to ensure easy solution of the disputes related to familial and social matters
• To identify reasons for harassment and difficulties that justice seekers face in the existing judicial system and to provide guidance for its solution in the light of Islamic rules
• In order to inform people about results and outcomes of researches and critical reviews mentioned above the Centre will publish quarterly, monthly and weekly journals and bulletin and documentary on regular basis, which will be enriched with necessary information about outcomes of researches and critical reviews
• To establish an Islamic law institute and to recommend to the authorities of the universities to include Islamic law in the university curriculums
• To establish a complete building complex for easy and full accomplishment of the wholeplanning of the Centre

০১. আধুনিক সমাজ ও রাষ্ট্রের চ্যালেঞ্জকে সামনে রেখে ইসলামী আইন ও তার প্রায়োগিক উপযোগিতা উপস্থাপন করা; ০২. ইনসাফ নিশ্চিত করার লক্ষ্যে প্রচলিত আইন ও বিচার ব্যবস্থা সংস্কারের সুপারিশ করা; ০৩. অসহায় ও নির্যাতিতদের আইনী সহায়তা প্রদান; ০৪. মহান আল্লাহ ও তাঁর রাসূল স. আনীত বিধান অনুসরণে গণমানুষকে উদ্বুদ্ধ ও উৎসাহিত করা; ০৫. উপর্যুক্ত লক্ষ্যসমূহ অর্জনের মাধ্যমে ন্যায় ও ইনসাফভিত্তিক সমাজ গঠন করা। কর্মসূচি

০১. দেশের প্রচলিত আইন ব্যবস্থায় পারদর্শী আইনবিদ ও ইসলামী আইনে পারদর্শী উলামায়ে কেরামকে সেন্টারের সাথে সংশ্লিষ্ট করা; ০২. প্রচলিত ব্রিটিশ আইন ও ইসলামী আইনের তুলনামূলক পর্যালোচনার মাধ্যমে ইসলামী আইনের শ্রেষ্ঠত্ব ও যৌক্তিকতা বিশ্লেষণ এবং তার প্রয়োগের দিক নির্দেশ করা; ০৩. আধুনিক সমস্যাবলী চিহ্নিতকরণ এবং ইসলামের আলোকে এগুলোর সমাধান উদ্ভাবন করা; ০৪. ইসলামী আইনের ওপর গবেষণা করে সময় উপযোগী ফিচার, সাময়িকী, পত্রিকা, পুস্তিকা এবং আইনগ্রন্থ রচনা ও প্রকাশ করা; ০৫. আরবী, ফার্সী, উর্দু, ইংরেজী থেকে ইসলামী আইন ও শরীয়াহ সম্পর্কিত মূল্যবান জ্ঞানগর্ভ গ্রন্থাবলী বাংলায় অনুবাদ ও প্রকাশ করা; ০৬. বিশ্বের বিভিন্ন দেশে ইসলামী আইনের উপর যে সমস্ত কাজ হচ্ছে এবং হয়েছে সেগুলো সংগ্রহ করে বাংলায় প্রকাশ করা; ০৭. বাংলা, ইংরেজী, আরবী, ফার্সী, উর্দু ভাষায় রচিত মূল্যবান বই ও জার্নালের সমন্বয়ে একটি সমৃদ্ধ লাইব্রেরি গড়ে তোলা; ০৮. ইসলামী আইন ও শরীয়ার ওপর এক দল গবেষক এবং পারদর্শী লেখক ও উপস্থাপক তৈরি করা; ০৯. দেশ-বিদেশের ইসলামী আইন বিশেষজ্ঞ ও গবেষকদের নিয়ে জাতীয় ও আন্তর্জাতিক সেমিনার, সিম্পোজিয়াম ও সম্মেলন আয়োজন করা; ১০. নারী ও শিশু নির্যাতনের কারণ নির্ণয়, নারী নির্যাতন রোধ এবং নারী ও শিশু অধিকার সুরক্ষায় ইসলামী বিধি-বিধানকে সুস্পষ্ট করে তুলে ধরা; ১১. মানবাধিকার বঞ্চিত দুঃস্থ ও অসহায়দের বিনামূল্যে আইনী সহায়তা প্রদান; ১২. মাদকাসক্তি, ঘুষ, দুর্নীতি, সন্ত্রাস, যৌতুক ইত্যাদি সামাজিক ব্যাধি দূরীকরণে জনগণকে সতর্ক ও অবগত করার পাশাপাশি সাধারণ মানুষকে এ কাজে সম্পৃক্ত করা; ১৩. কারা ব্যবস্থা সংস্কারের উদ্দেশ্যে কয়েদী ও হাজতীদের অধিকার সম্পর্কে ইসলামের বিধি-বিধান উপস্থাপন করা। পরিকল্পনা

০১. ইসলামী আইন সম্পর্কে সামগ্রিক গবেষণার জন্য একটি সমৃদ্ধ লাইব্রেরি প্রতিষ্ঠা করা; ০২. ইসলামী আইনের পক্ষে গণ-সচেতনতা সৃষ্টির উদ্দেশ্যে সেমিনার, সিম্পোজিয়াম ও সম্মেলন অনুষ্ঠান এবং ইলেক্ট্রনিক, প্রিন্টিং ও সামাজিক প্রচার মাধ্যমে প্রচারণা জোরদার করা; ০৩. কোন ঘটনাকে কেন্দ্র করে ইসলামী আইনের বিরুদ্ধে সংঘবদ্ধ অপপ্রচার প্রতিরোধে প্রয়োজনে তদন্তকারী প্রতিনিধি প্রেরণ এবং সংশ্লিষ্ট বিভিন্ন মহলের সাথে যোগাযোগ করে প্রকৃত সত্য উদ্ঘাটন করা; ০৪. প্রচলিত আইন ও প্রশাসনিক রীতি পদ্ধতির ত্র“টি তুলে ধরা এবং গবেষণামূলক পর্যালোচনার মাধ্যমে সকল প্রকার সামাজিক ব্যাধির প্রতিষেধক নির্ণয় করা ও পরামর্শ প্রদান; ০৫. মানবাধিকার বিশেষ করে নারী ও শিশু অধিকার সংরক্ষণের ক্ষেত্রে অন্যান্য ধারণার সাথে ইসলামী ধারণার তুলনামূলক পর্যালোচনা করে বই, বুকলেট, ডকুমেন্টারি ইত্যাদি প্রকাশ করা; ০৬. ধর্মীয় সংখ্যালঘুদের অধিকার সংরক্ষণে ইসলামী বিধি-বিধানের ভূমিকা সম্পর্কে গণসচেতনতা সৃষ্টি করা; ০৭. বিদ্যমান আদালতগুলোতে মামলার চাপ কমানো এবং পারিবারিক ও সামাজিক বিরোধের সহজ সমাধানের জন্য ইসলামী আইনের আলোকে সালিশীবোর্ড গঠনের জন্য সরকারি অনুমোদন লাভের ব্যবস্থা করা; ০৮. বিদ্যমান বিচার ব্যবস্থায় বিচারপ্রার্থীদের দুর্ভোগের কারণ নির্ণয় এবং তা দূরীকরণে ইসলামের আলোকে পথ নির্দেশ করা; ০৯. উপরে উল্লিখিত গবেষণা ও তথ্য-ভিত্তিক আলোচনা পর্যালোচনার ফলাফল সম্পর্কে জনসমাজকে অবহিত করার জন্য নিয়মিত ত্রৈমাসিক, মাসিক, সাপ্তাহিক পত্রিকা, বুলেটিন এবং তথ্যভিত্তিক ডকুমেন্টারি প্রকাশ করা; ১০. একটি ইসলামী আইন ইনস্টিটিউট প্রতিষ্ঠা করা। সেই সঙ্গে বিদ্যমান বিশ্ববিদ্যালয়গুলোর পাঠ্যসূচিতে ইসলামী আইন সংযুক্ত করার সুপারিশ করা; ১১. সেন্টারের পরিকল্পনা বাস্তবায়নের জন্য একটি পূর্ণাঙ্গ কমপ্লেক্স প্রতিষ্ঠা করা।
